Precautionary attachment, known as ihtiyati haciz, can help preserve a Turkish debtor's assets before ordinary debt recovery reaches its final stage. It requires a legal application and implementation through the proper procedure. An unpaid invoice does not give a creditor a private right to instruct the debtor's bank to freeze money.

For a foreign creditor, the important questions are whether the debt qualifies, what the documents establish and whether the creditor is ready to fund security and act on the resulting deadlines. Obtaining an order and actually recovering payment are different milestones.

Contents

1. What Does Precautionary Attachment Achieve?

The measure seeks to preserve value in the debtor's attachable property or rights for a monetary claim. It does not finally decide every dispute about the debt and does not itself transfer an attached balance to the creditor. The main claim and required continuation steps remain important after preservation is obtained.

This is different from an interim injunction directed at a particular disputed right or asset. The legal basis should match the relief sought. A request to preserve assets for an unpaid price should not simply be labelled an injunction without considering the attachment rules.

Reports to an overseas finance team should distinguish the amount claimed, the scope of the order, assets actually reached and likely recovery. Existing security rights, other creditors and the debtor's financial position can affect the value ultimately available. An order for the full claimed sum does not mean that assets of that value have been located.

An attachment order is one stage of a recovery strategy
StageMain taskWhat remains unresolved
Eligibility reviewDebt maturity, security and evidenceWhether the court will grant protection.
Order and implementationSecurity and timely enforcement requestWhether sufficient assets will be reached.
Continuation of proceedingsMain claim and procedural deadlinesThe final entitlement and challenges.
Recovery or settlementPayment and controlled releaseCompeting rights and actual collectible value.

The ten-day implementation requirement and later continuation deadlines are separate.

2. Which Debts May Qualify?

Article 257 of the Enforcement and Bankruptcy Law is the starting point for due monetary debts not secured by a pledge or mortgage. The Ministry of Justice's legal dictionary identifies that basic distinction. Claims that are not yet due engage narrower statutory grounds and should not be treated as ordinary overdue debts.

Check when payment became due and whether a condition remains outstanding. An invoice issued before acceptance of goods may not establish maturity by itself. Existing collateral and any unsecured portion of the claim also need attention rather than an assumption that every commercial balance is eligible.

Urgency should be explained accurately. Where relevant, identify a proposed disposal, closure of operations or another verifiable development. Do not invent a risk of asset flight to strengthen an application, or assume that such a narrative is an additional requirement for every due-debt application. The statutory route determines what must be shown.

3. Connect the Debtor, Performance and Outstanding Balance

The evidence should show who owes the money, why it is owed, when it became due and how the amount was calculated. Contracts, orders, invoices, delivery or acceptance records and written acknowledgements can work together. One document rarely answers every part of that sequence.

Reconcile partial payments, credits and disputed deductions before filing. If the debtor alleges defects, non-delivery or set-off, include the correspondence and the creditor's response. An urgent application should still present a defensible account rather than omit material that may emerge immediately when the debtor objects.

A short chronology and document index help identify what needs translation and which gaps matter. Preserve originals and the full context of electronic correspondence. The aim is to give the court a clear evidential basis for the requested measure, not an unstructured archive of the commercial relationship.

4. Identify the Right Assets and Check Competing Proceedings

Start with the debtor's exact registered identity and reliable information about property, accounts, receivables or other assets. A trade name, shared address or group website does not establish that an asset belongs to the debtor. Exemptions and third-party rights also need examination.

A parent company, director and shareholder are not interchangeable with the company that contracted. A guarantee may create a separate obligation, but its terms and validity must be assessed. Seeking assets of a related person without a proper basis can create additional risk rather than improve recovery.

Review any arbitration clause, pending lawsuit, enforcement file or restructuring process before the application. Asset preservation and the proceedings determining the debt have different functions, but they must be coordinated. An insolvency or concordat measure may materially affect what can be done and when.

5. What Security and Financial Exposure Should You Expect?

The court may require security against loss caused by an unjustified attachment. The amount and acceptable form depend on the file and applicable exceptions; a percentage quoted in another case is not a universal tariff. Plan the funding before the order, because an inability to provide security can prevent timely implementation.

Foreign-party security is a separate issue. The Ministry of Justice's guidance explains security obligations and exemptions relevant to foreign parties. Nationality, legal personality, treaties and reciprocity may need assessment. An exemption from one form of security should not be assumed to remove every security requirement.

Wrongful attachment can expose the creditor to a compensation claim. Verify the debtor, amount, maturity and payments, and keep the requested measure proportionate to the supported claim. Preservation should be assessed as a legal remedy with potential liability, not a risk-free way to pressure a trading partner.

6. an Order Must Be Implemented and Followed Up

Article 261 requires the creditor to request implementation within ten days from the attachment order through the competent enforcement office. The Ministry of Justice's published case-law record sets out this requirement. The order date, not a convenient later date for internal approval, must be visible in the case calendar.

Article 264 governs further continuation steps, whose triggers depend on the procedural history. Whether proceedings already exist, how attachment was carried out and whether an objection has been notified can matter. Applying a single generic seven-day countdown to every file risks using the wrong starting point or procedure.

Assign responsibility for security, implementation, service records and the main claim before filing. If mediation or arbitration is relevant, its relationship with preservation deadlines needs specific consideration. Settlement talks should run alongside this calendar, not silently replace the required legal steps.

Missing a continuation requirement can cause the protection to fall away. A creditor abroad should therefore arrange decision-making authority and funding promptly rather than treat the order as a document to consider at the next scheduled management meeting.

7. Challenges, Payment Proposals and Releasing the Measure

The debtor may challenge the attachment through the applicable procedure. Keep the application, order, implementation records and notifications together so counsel can respond on the correct grounds and dates. The measure's existence does not remove the need to prove and pursue the underlying claim.

Update the balance if payment is received or an error is found. Continuing to preserve assets for an overstated debt can increase exposure. Where another creditor or secured party has rights, distinguish the nominal asset value from the amount realistically available for this claim.

A settlement should coordinate repayment with release of protection. Specify instalments, currency, default consequences and any replacement security. Releasing the only effective protection against a promise to pay later may change the commercial position substantially.

Recovery still requires the appropriate outcome and continuation of the debt process. Our debt collection guide explains the wider distinction between a demand, enforcement proceedings and payment.

8. Assess Urgent Creditor Protection with Legal Istanbul

Legal Istanbul can review eligibility, the debt evidence, asset information and the procedural route. The assessment can identify missing documents, likely security issues and the steps needed after an order, as well as whether ordinary collection or settlement is more proportionate.

Start with the debtor's legal name, amount, currency, due date, existing security and any dispute-resolution clause. Mention pending proceedings and a specific threatened transaction if known. Distinguish confirmed information from an intermediary's account.

A preservation application cannot guarantee that assets exist or that the final claim will succeed. The useful outcome of the initial review is a clear view of eligibility, urgency, funding and follow-up, allowing the creditor to decide whether the proposed action is justified.

9. FAQ

Can a foreign creditor obtain precautionary attachment in Turkey?

It may be available where the claim and evidence meet the legal conditions. Foreign-party security and any exemption must be assessed separately from the merits of the attachment request.

Can I freeze a bank account using an unpaid invoice?

Not by privately instructing the debtor's bank. The invoice is part of the evidence for a legal application. A court order and proper implementation are required for the attachment route.

Must the debt already be due?

The ordinary starting point is a due monetary debt not secured by a pledge or mortgage. A claim not yet due engages narrower statutory grounds. Maturity and any collateral need specific review.

Is there a fixed security percentage for every application?

No universal percentage should be assumed. The court's requirements, statutory exceptions and documents matter. Separate security obligations for a foreign party may also arise.

How long is there to request implementation of the order?

Article 261 requires an implementation request within ten days from the order. Further continuation deadlines are separate and depend on the procedural history.

Does the attachment order mean I have won the debt case?

No. Preservation and final recovery are different. The debt may remain disputed, and the appropriate main proceedings and follow-up steps are still necessary.

Can I attach a director's assets for a company debt?

Not simply because the person is a director or shareholder. A separate legal basis, such as an enforceable personal obligation, must be assessed. Related parties are not interchangeable debtors.

Do settlement talks suspend the follow-up deadlines?

Do not assume so. Negotiations must be coordinated with the procedural calendar. Missing a required step may cause protection to fall away even while discussions continue.

Can an unjustified attachment create liability for the creditor?

Yes. Wrongful attachment can lead to a compensation claim. The evidence, amount, debtor identity and subsequent payments should be checked carefully before and during the process.
