Entry Bans and
Restriction Codes

Legal review of restrictions affecting entry to Turkey.
Advice on records, legal challenges and permission to return.

01 / Legal framework

Entry Restrictions and the Right to Return

An entry ban may prevent a foreign national from returning to Turkey. A restriction code is a record used by the authorities and does not always mean that the same type of ban applies. The first step is to identify the decision, its reasons, its duration and the date it was notified.

Main legal framework
Law No. 6458, Articles 7 to 10
First priority
Identify the decision and protect any challenge deadline

An entry restriction may be reconsidered by the responsible authority or challenged before an administrative court. Article 9 also allows permission to enter for a limited period while the ban remains in place. These are different legal outcomes, and the correct route depends on the file.

Legal Istanbul advises people outside Turkey, travellers refused admission and families dealing with related immigration decisions. The review considers both the immediate restriction and the intended visit. Resolving an entry issue does not automatically provide residence, employment or citizenship rights.

If someone is currently being held or faces removal, tell us at the first contact. Those circumstances may require action separate from an application about future entry.

02 / Legal services

Legal Review and Representation

We assess what is known, which records are missing and what legal steps remain available. The work depends on the decision and the stage of the matter, rather than the code alone.

01

Reviewing Immigration Records

Checking notices, travel history, payment records and the connection between an entry restriction and any other decision.

02

Assessing Grounds and Deadlines

Examining the reasons, notification history, factual errors and legal time limits before choosing a response.

03

Preparing Applications and Cases

Preparing appropriate requests to the administration or court proceedings, including requests to suspend a decision where relevant.

04

Reviewing the Position After a Decision

Checking the effect of an outcome, following up on records and identifying remaining entry or visa requirements.

The written engagement sets out the work, fees and responsibility for deadlines. Obtaining records, making an administrative request and conducting a court case are separate tasks. A criminal case, detention challenge or residence dispute may require additional instructions.

Representation can often begin while the client remains abroad. However, no lawyer or private intermediary can promise to delete a government record or guarantee admission on a particular date. Where information is incomplete, the assessment should explain that limitation.

03 / Identifying the measure

Entry Bans, Border Refusals and Other Decisions

Several measures can follow the same incident. They should be reviewed together, but not treated as one decision with one remedy.

Decisions That Require Separate Review
MeasureWhat it concernsKey distinction
Entry banA restriction on entering Turkey. The decision's grounds, dates and remaining effect need checking.
Border refusalAdmission refused during a particular journey. It does not always establish that a long-term ban exists.
Prior permissionEntry subject to advance approval. It is not identical to a fixed-period entry ban.
Removal decisionA decision to send a person out of Turkey.A separate and short court challenge period applies.
Administrative detentionBeing held during immigration procedures.Review of detention is separate from the entry or removal case.

A residence refusal or cancellation can add another issue. For example, a court decision concerning removal does not necessarily cancel an independently recorded entry restriction. Similarly, release from a removal centre does not itself establish permission to live or work in Turkey.

An exit restriction prevents departure and raises a different question from an entry ban. If a criminal court has imposed a travel restriction, an immigration application is not the procedure for lifting that court order.

04 / Understanding the record

What a Restriction Code Can and Cannot Show

Turkish immigration records use letter-and-number references commonly called restriction codes, or tahdit kodlari. The code may help identify the subject of a record, but it does not explain all the evidence, dates or legal consequences.

Published Constitutional Court decisions illustrate this distinction. N-82 appears in connection with prior permission for entry, while G-87 appears in general-security restriction records. These examples do not mean that everyone with the same code has the same history or legal options.

Examples: Constitutional Court applications 2019/40761 and 2018/6143. Case-specific descriptions are not a complete official codebook.

A code is not a criminal conviction. Where a record refers to an allegation or security assessment, the legal review should identify the information relied upon and whether it concerns the correct person. Equally, the absence of a conviction does not automatically make every administrative restriction unlawful.

Preserve the exact letters and numbers shown on a notice. A missing letter or a code copied from someone else's case can lead to the wrong question. Our restriction-code article gives more detailed descriptions and identifies their sources; it should be read alongside the person's own record.

To assess the code’s meaning and legal effects, read our guide to restriction codes.

05 / Before travel

Checking a Restriction Before Booking Travel

Start with the last refusal or departure notice, rather than testing the position by taking another flight. A ticket, boarding pass or airline booking does not confirm that Turkish border authorities will permit entry.

The review should identify the authority responsible for the decision, the recorded reason and any start or end date. It should also establish whether another measure remains active. An old notice may describe only part of the current position.

With appropriate authority, a lawyer can request relevant records through the available procedures. Access depends on the type of information and any legal restrictions. It would be misleading to promise an immediate or complete search of every government system.

Match old and new passport numbers, name spellings, nationality and date of birth across the documents. A genuine error may need correction, but a renewed passport does not erase the underlying immigration history. Keep any written response and the date it was received.

06 / Duration

How Entry Ban Periods Are Assessed

Article 9 of Law No. 6458 provides a general maximum of five years. Where there is a serious public-order or public-security threat, the period can be increased by up to an additional ten years. These are statutory limits, not standard periods imposed on every traveller.

The actual period depends on the legal basis and individual decision. Overstay-related measures also depend on the departure circumstances and the published administrative rules. A general label such as a short-term or security ban is not enough to calculate an end date.

Ask which date starts the period, what the decision records and whether there are separate conditions for admission. The end of one ban does not necessarily settle unpaid public debts or another restriction. A prior-permission requirement should not be assumed to expire on the same day as an unrelated ban.

Article 9 also allows an earlier lifting of the ban or limited entry while it remains. Either outcome requires a proper decision; the passage of time or a personal reason to visit does not create that permission.

07 / Stay-related restrictions

Overstay, Departure and Unpaid Amounts

Overstay consequences cannot be calculated from the number of days alone. The official guidance distinguishes voluntary departure before detection, departure after an official instruction, non-payment and removal. The relevant visa, residence or work permission must first be identified.

Facts That Affect An Overstay Review
IssueEvidence to examineWhy it matters
Length of the breachPermission dates and actual entry and departure records.Different periods can lead to different consequences.
Departure circumstancesVoluntary departure, detection and any invitation to leave. The published rules distinguish these situations.
PaymentThe assessment, receipt and payment reference.A receipt should be matched to the correct debt.
Other restrictionsSeparate entry, security or prior-permission records.Settling an overstay issue may leave another obstacle.

The published guidance includes a no-ban category for breaches of less than three months where the person leaves voluntarily before detection and pays the required amounts. This is a conditional category, not a general three-month grace period or permission to overstay.

Payment settles the relevant financial obligation; it does not automatically cancel every entry restriction. Unpaid amounts may also remain an obstacle after a ban period ends. Keep the original assessment and receipts, including any removal-related costs that are separate from the overstay fine.

Source: Migration Management's published guidance dated 9 June 2020, consulted on 19 October 2026. The applicable category and current record require individual confirmation.

To explore a stay-related period, use the entry-ban duration calculator and read the conditions and exceptions in the guide.

08 / Notification and time limits

Time Limits for Different Legal Challenges

Identify the decision before calculating the deadline. The date printed on a decision, the date it was notified and the date a family member heard about it may differ.

Entry, Removal And Detention Are Different Procedures
MatterGeneral procedural positionImportant caution
Entry-ban court challengeThe ordinary administrative-court filing period is sixty days where no special period applies.Notification, knowledge of the decision and any formal application must be reviewed.
Removal decisionArticle 53 provides seven days from notification for a court challenge.Do not apply the ordinary sixty-day period to a removal decision.
Administrative detentionA separate challenge is made to the criminal judgeship of peace. An entry-ban or removal case does not itself challenge detention.

The general sixty-day rule comes from Article 7 of Law No. 2577. Under the ordinary counting rule, time begins on the day after notification. However, where written notification is disputed or missing, knowledge of the decision may also require examination. Do not assume that having no copy means there is unlimited time.

A properly made administrative request can affect some court periods, but not every enquiry has that effect. A phone call, consular appointment or unanswered email should not be relied upon to protect a deadline. Obtain advice before waiting for a response.

09 / Applications to the authority

Record Correction and Administrative Review

A correction request addresses an inaccurate fact, such as a payment recorded as outstanding or a decision linked to the wrong identity. A request to lift or reconsider a restriction addresses the measure itself. These requests should identify exactly what needs to change and why.

Supporting evidence should answer the recorded concern. If payment is disputed, provide the receipt and assessment reference. If circumstances have changed, explain when and how the change occurred. A letter saying only that the person wishes to visit Turkey may not address the reason for the restriction.

The Effect on a Court Deadline

Where Article 11 of Law No. 2577 applies, a request made to the appropriate authority within the court filing period can pause that period. If no answer is given within thirty days, the request is treated as refused. Following an express or deemed refusal, the remaining filing time continues; days already used are not restored.

A new request does not automatically restart an expired deadline. Its legal basis, timing, recipient and evidence of delivery all matter. The review should decide whether this route is suitable before relying on it instead of filing a court case.

10 / Judicial review

Challenging an Entry Ban in Court

An action for annulment asks an administrative court to set aside an unlawful decision. The case must identify the challenged measure and explain why it is unlawful. A disputed identity, unsupported factual assessment, procedural defect or failure to consider relevant circumstances may require different evidence.

The court examines the administration's decision and the material before it. The applicant's account should be supported by documents where available. A security description should not be treated as proof of guilt, but a general denial may also fail to address the particular information relied upon.

Temporary Court Orders

Filing an entry-ban case does not automatically suspend the restriction. A request for a stay of execution asks the court to pause the decision while the case is considered. Article 27 of Law No. 2577 generally requires both clear unlawfulness and harm that would be difficult or impossible to repair.

Explain the specific harm and provide evidence. A refusal to suspend the ban is not the same as the final decision on the case. Similarly, an interim order should be read for its scope and effect before it is treated as permission to travel.

Following a favourable judgment, implementation and any remaining measures still need review. The judgment concerns the decision before the court; it does not necessarily resolve a separate visa refusal, debt or criminal travel restriction.

11 / Limited entry and visas

Permission to Enter While a Ban Remains

Article 9 distinguishes lifting a ban from allowing entry for a specified period while the ban remains. A limited-entry request should explain the purpose, proposed dates and evidence supporting the visit. It is not an automatic alternative to challenging an unlawful decision on time.

Lifting the restriction
The relevant ban is removed by an appropriate administrative or judicial outcome. Other entry conditions still need checking.
Limited permission
The person may be allowed to enter under defined conditions while the underlying ban continues. The permission must be used within its scope.

The expression mesruhatli vize, often translated as an annotated visa, is used in discussions of purpose-specific travel. The label is not a promise that a visa will override a restriction. The existing record and the necessary approval must be considered through the appropriate official procedure.

A visa does not create an unconditional right to enter Turkey. It also does not provide permission to work or to remain indefinitely. See the Ministry of Foreign Affairs' visa information for the distinction between travel purposes.

12 / Supporting circumstances

Family Life, Children and Medical Needs

Family ties and health needs may be relevant to a request or legal challenge. The assessment should explain how the restriction affects the person and their family, rather than rely only on the existence of a marriage or a relative in Turkey.

For a family matter, useful evidence may include marriage and birth records, proof of the family's residence, care arrangements and a child's particular needs. Where separation affects a child, explain the child's actual circumstances and the role of the parent seeking entry.

A medical request should identify the treatment, its timing and why entry is needed. A hospital letter should support the stated purpose rather than simply confirm that an appointment was booked. An urgent medical need should be raised promptly, but it cannot guarantee a decision before the proposed travel date.

Property ownership, a business interest or a Turkish spouse does not automatically cancel a restriction. These facts must be assessed alongside the grounds relied on by the authority. Our residence permit service addresses the separate conditions for a longer stay after entry.

13 / Refusal and detention

Refusal at the Airport and Related Removal Issues

If admission is refused, ask for the written decision and an explanation of the procedure. Keep the passport details, flight information, time of the incident and any documents provided. A relative assisting from outside should establish the person's location and whether a separate removal or detention decision has been issued.

Ask for language assistance where needed to understand the documents. Do not describe a document as a simple receipt without checking whether it records notification, consent or another legal step. Tell the lawyer about anything already signed.

An airport refusal under the entry rules and a removal decision issued inside Turkey are not automatically the same procedure. Administrative detention is also distinct. The removal-decision article and detention article explain those related issues.

If return would expose the person to torture, inhuman treatment or a threat covered by protection law, raise that risk immediately with the authorities and legal representative. Articles 4 and 8 of Law No. 6458 contain safeguards concerning return and access to international protection. A routine future-entry request is not a substitute for addressing an immediate protection need.

14 / Preparing the file

Documents for an Entry Restriction Review

The first review can begin with the documents already available. Missing records should be identified without allowing an urgent deadline to pass while waiting for a complete file.

Giving Instructions from Abroad

A power of attorney authorises a lawyer to act within its stated scope. Before issuing one abroad, confirm the wording, identification, authentication and translation requirements. The route may involve a Turkish consulate or an appropriately certified foreign document; requirements vary by country and document.

Keep original records and share sensitive identity, family or medical material through an agreed channel. For an initial enquiry, the current country, nationality, decision date and a short account of events are useful. Our power of attorney article explains preparation in more detail.

15 / Case preparation

Review Stages, Costs and Follow-Up

The sequence below provides a practical framework. An urgent court deadline or detention issue may require immediate action before all records have been obtained.

  1. Identify the Decisions

Separate the entry, residence, removal and detention measures that affect the person.

  2. Review the Dates

Check notification, travel history, ban periods and any urgent filing deadline.

  3. Assess the Evidence

Compare the reasons with the documents and identify missing information.

  4. Take the Legal Step

Prepare the appropriate administrative request, court case or limited-entry application.

  5. Check the Outcome

Review the decision, implementation and any remaining requirements before travel.

Costs To Clarify Before Representation
ItemWhat to confirm
Legal workRecord review, administrative representation and litigation included in the agreement.
Court and document costsApplicable filing expenses, translations, certification and power of attorney costs.
Existing liabilitiesAny fine or removal-related amount, separate from professional fees.

There is no single processing period for every restriction. Requests for records, administrative decisions and court proceedings follow different procedures. A successful step may still require implementation or another approval. Fees should describe the work undertaken, not imply payment for a guaranteed result.

16 / Questions

Common Questions About Entry Restrictions

Can An Entry Ban Be Lifted Before It Ends?

It may be possible through an appropriate administrative decision or court challenge. The legal basis, evidence and deadlines must be reviewed. Article 9 also allows limited entry while a ban remains, which is different from removing it.

Does Every Restriction Code Mean An Entry Ban?

No. Records may concern a ban, prior permission, an immigration issue or another requirement. The code alone does not establish its full effect. Obtain the exact reference and review the related decision and current record.

Does Paying The Fine Remove The Ban?

Not necessarily. Payment concerns the relevant debt. It may affect an overstay assessment or resolve a payment issue, but it does not automatically remove a separate ban or security restriction. Keep the assessment and receipt together.

Can I Return With A New Passport?

A new passport does not erase an immigration restriction linked to your identity. Review the existing decision and any remaining conditions before travel. A different document number should not be treated as a way around the restriction.

Is The Deadline Always Seven Days?

No. The seven-day period concerns a removal decision under Article 53. An entry-ban challenge usually falls under the ordinary administrative-court rules. Identify each decision and its notification history before calculating the relevant period.

Can A Lawyer Act While I Am Abroad?

Many preparation and representation steps can be handled with a suitable power of attorney while you remain abroad. Confirm the document requirements and agreed work first. Representation does not remove every possible requirement for personal attendance.

Does Having A Turkish Spouse Cancel A Restriction?

No. Marriage and family circumstances may be relevant evidence, but they do not automatically cancel a ban or other record. The assessment should address both the family situation and the authority's reasons for the measure.

Can I Travel While A Request Or Court Case Is Pending?

A pending entry-ban request or case is not travel permission. Any interim order, limited-entry approval and visa must be checked for its actual effect. Confirm remaining restrictions before making non-refundable arrangements.
