01 / Restrictions On Leaving Turkey
Exit Bans in Turkey
An exit ban is a restriction on leaving Turkey. In criminal proceedings, a judge or court may impose it as a form of judicial control under Article 109(3)(a) of the Criminal Procedure Code, Law No. 5271. Judicial control allows the authorities to apply conditions without keeping the person in pre-trial detention. An exit ban is not a finding of guilt.
This page focuses on that judicial restriction and the practical questions it creates for foreign nationals. A person may need to return to work abroad, continue medical treatment or join family members. Those needs matter, but they do not cancel a court order by themselves.
The first task is to identify the actual restriction. A warning at passport control, an arrest record, an invalid travel document and a judicial exit ban may require different responses. The wording of the decision is more important than the informal name used for it.
Legal Istanbul reviews the Turkish case, advises on available applications and represents clients within an agreed scope. Advice should be based on the current order and procedural stage, not only a missed flight or an account of what happened at the airport.
02 / Scope Of Representation
How We Assist with Exit Ban Matters
The work may begin before planned travel or after a person has been prevented from leaving. A deadline or immediate loss of liberty needs prompt attention and should be mentioned at the first contact.
Order and File Review
Identify the authority, case number, legal basis and current restrictions.
Applications and Objections
Prepare a supported request to lift, change or review the measure.
Urgent Travel Evidence
Organise records showing the purpose, dates and practical need for travel.
Decision Follow-Up
Check the terms of a new order and its communication to the relevant authorities.
We confirm authority to act, possible conflicts and the agreed tasks before representation begins. A family member can help establish contact, but access to confidential information requires an appropriate basis. The client should know who will receive updates.
A request concerning travel may be only one part of a wider criminal defence matter. The agreement should state whether hearings, defence of the allegation, further objections and immigration work are included. These tasks do not become part of an engagement simply because they concern the same person.
03 / Different Decisions, Different Remedies
Exit Bans, Entry Bans and Other Border Problems
An exit ban is not the same as an entry ban. One restricts departure; the other concerns admission to Turkey. A person may have more than one record, and changing one does not necessarily resolve the others.
| Issue | Main Question | Starting Record |
|---|---|---|
| Judicial exit ban | Does a court order prevent departure? | Judicial control order and later decisions. |
| Entry ban | Is admission to Turkey restricted? | Migration decision and relevant restriction record. |
| Removal or detention | Is a separate immigration procedure active? | Removal or administrative detention decision. |
| Passport problem | Is the travel document valid and accepted? | Passport status and the stated reason for refusal. |
| Arrest or police alert | Is there a separate basis for arrest or questioning? | Warrant, alert and Turkish case information. |
An entry visa, residence permit or permission concerning an entry ban does not lift a judicial exit ban. Similarly, cancelling an exit ban does not resolve an outstanding arrest order. Entry ban advice and Interpol-related review should be coordinated where those issues are present.
04 / Establishing The Current Position
Checking the Order and Case Records
Useful starting information includes the court or prosecutor's office, case number, decision date, passport details and any written notice. Keep the original documents and record when and how each one was received. A photograph of only the first page may omit the actual terms or information about objections.
Where access is available, UYAP can help a person follow case information and documents. It is not a travel clearance certificate. An empty portal search does not prove that no restriction exists. Access depends on the account, file and applicable rules; investigation records may require further enquiries by an authorised lawyer.
Counsel should compare the first order with later decisions. A ban may have been continued, changed or lifted, while other conditions remain. A similar name, different spelling or old passport number also needs careful checking against the person's full identity.
Do not share an e-Devlet password or electronic signature credentials. Documents can be provided through an agreed secure channel, and a lawyer uses their own authorised access. Any limits on the records obtained should be made clear in the advice.
05 / When Departure Is Refused
Being Stopped at Passport Control
Ask for the reason for the stop and the authority or case reference, where it can be provided. Keep any written record, boarding pass and notice. Record the time and place of the check. These details help distinguish a travel restriction from a separate arrest, identity or immigration issue.
If you are detained or questioned, request legal assistance and an interpreter if needed. Ask for the content of any document to be explained before signing. A travel problem may require immediate criminal defence work; it should not be treated only as a request to recover the cost of a ticket.
Airport officers do not replace the judge or court that must decide whether a judicial exit ban should change. A consulate may assist within its role, but cannot cancel a Turkish court order. An airline cannot grant an exception either.
Do not try another passport or crossing to avoid the restriction. Intentional failure to comply with judicial control can have serious consequences under Article 112, including a possible detention order. Resolve the legal position before another attempt to leave.
06 / Reasons For The Measure
When Judicial Control May Be Ordered
Article 109 links judicial control to the criminal procedure framework, including the detention grounds in Article 100. It also allows judicial control in situations where the law prohibits detention. The legal assessment therefore concerns the allegation, evidence and reasons for the measure, not simply whether the person holds a foreign passport.
During an investigation, a criminal judgeship of peace may impose judicial control on the prosecutor's request. During prosecution, the competent judicial authority deals with the measure. The correct authority for a later application depends on the stage reached in the case.
A request for review should address why the restriction is needed now. Relevant points may include attendance at hearings, compliance with existing conditions, a verified address and changes in the evidence. Foreign nationality alone should not replace an individual assessment of the facts.
The Constitutional Court's published case summaries stress the temporary nature of protective measures and the need for relevant reasons when restrictions continue. The effect on private and family life must be assessed on the individual facts. This does not mean that every long-running exit ban is automatically unlawful.
07 / Removal, Change Or Temporary Relief
Requesting a Change to an Exit Ban
Articles 110 and 111 provide routes to review judicial control. Depending on the facts, an application may seek full removal, a different condition or temporary exemption from a condition. The request should state clearly what decision is sought and why it is suitable.
| Request | Purpose | Important Limit |
|---|---|---|
| Lift the exit ban | End the travel restriction. | Other orders may still remain in force. |
| Change judicial control | Consider another suitable condition. | The applicant cannot choose an alternative without an order. |
| Temporary exemption | Allow a defined period of travel. | Dates and all attached conditions must be followed. |
| Objection to a decision | Seek review through the statutory objection procedure. | The relevant deadline and reviewing authority must be checked. |
Under Article 111, the judge or court considers a request after obtaining the prosecutor's opinion, with a five-day decision provision. That provision is not a promise of removal within five days or confirmation that border records will be updated within that time.
Security or another condition is not an automatic price for permission to leave. It requires the appropriate judicial decision and must be assessed against the circumstances of the file.

08 / Deadlines And Effect Of Filing
Objecting to an Exit Ban Decision
Judicial control decisions can be challenged through the objection procedure. The general time limit under Article 268 is two weeks from learning of the decision in the legally relevant manner, unless a specific rule applies. The decision, notification record and any applicable transitional rules should be checked before calculating the deadline.
Older material referring to a general seven-day period may not reflect the amended law. Do not wait for a future flight date to address a decision already received. Keep the notice, envelope, hearing record or electronic notification details available for review.
An objection is submitted through the authority that made the decision. The competent review authority depends on the type of decision and the court involved. A request to reconsider an ongoing measure and an objection to a particular decision are related but distinct procedures.
Filing an objection does not automatically suspend the order. Article 269 allows the relevant authority to decide on suspension, but the applicant should not assume that submitting papers permits departure. Continue to follow the existing conditions unless an effective decision changes them.
09 / Supporting A Defined Request
Travel for Health, Work and Family Reasons
An urgent travel need should be supported by specific evidence. Explain why the person must travel, why the proposed dates matter and why another arrangement would not meet the need. A purchased ticket alone does not establish that the court should allow departure.
| Reason | Useful Records | Detail To Explain |
|---|---|---|
| Medical treatment | Medical report, appointment and treatment plan. | Urgency, location and expected duration. |
| Employment or business | Employer letter, contract or dated meeting records. | Why attendance is necessary and what delay would cause. |
| Family responsibilities | Family records and evidence of illness or care needs. | The person's role and the needs of those affected. |
| Status abroad | Foreign residence document and official deadline. | The actual consequence of missing the date. |
Where relevant, include a return plan, address and arrangements for future hearings. Records must be accurate and consistent with the criminal file. Translations or verification may be needed for foreign documents. Personal hardship is relevant evidence, not an automatic exemption.
10 / Continuing Restrictions
How Long Can an Exit Ban Remain in Place?
There is no single duration that applies to every exit ban. The current order, type of proceedings and statutory rules must be read together. Article 110/A sets maximum periods for judicial control, with different rules for cases within or outside the jurisdiction of a high criminal court, extensions, certain offences and children.
Article 110 also requires consideration of whether judicial control should continue at intervals of no more than four months. This review interval is not an automatic expiry date. A person should not assume that travel is allowed merely because four months have passed.
A useful chronology lists the first order, each continuation decision, changes to conditions, applications and responses. It also identifies changes in the case, such as evidence being collected or the proceedings moving to a different court.
Where work or family life abroad is affected, describe the actual impact and provide supporting records. A general statement that the restriction is inconvenient may not explain the seriousness of the situation. Continued restrictions should be reviewed against their purpose and current reasons, not only the wording of the first order.
11 / Immigration And Related Proceedings
Residence, Passports and Other Restrictions
A judicial exit ban does not grant or extend a residence permit. A foreign national who must remain in Turkey should separately review immigration status and any approaching deadline. The existence of a court order may be relevant to an explanation, but should not be treated as automatic permission to stay or work.
Likewise, paying an overstay fine does not remove a judicial exit ban. Overstay and visa issues may affect departure and later entry in a different way. Advice should cover both procedures where necessary.
Renewing a passport or holding a second nationality does not cancel an order against the person. Give counsel details of all relevant identity records so differences can be explained lawfully. A separate extradition case or removal procedure may require its own applications.
For a child, custody, consent and travel-document questions may also arise. Permission relating to an adult's criminal case should not be assumed to decide whether a child may travel. Identify any separate family court order before making arrangements.
12 / Avoiding Outdated Assumptions
Does an Unpaid Debt Create an Exit Ban?
An ordinary unpaid debt is not, by itself, a judicial exit ban under Article 109. A payment dispute, tax assessment and criminal allegation are different matters. The actual legal basis must be identified before deciding that payment will resolve a travel problem.
The former public debt exit restriction practice under Article 36/A of Law No. 6183 is no longer in force. Revenue Administration guidance records the end of that practice following the 2010 constitutional change. Older explanations of tax-office exit restrictions should not be presented as the current general procedure.
A dispute involving money may nevertheless include a separate criminal investigation, for example an allegation of fraud or a tax offence. In that situation, any judicial control measure must be assessed within the criminal case. Payment or settlement does not automatically cancel the measure.
Do not make a payment to someone who promises to remove a court restriction through personal contacts. Official payments, agreed legal fees and any court-ordered security should be clearly identified and documented. A receipt is not a substitute for the required judicial decision.
13 / Preparing The File
Documents and the Scope of Legal Fees
A complete set of relevant records helps identify the next step. Where a document is missing, say so rather than replacing it with an assumption. Sensitive medical or family information should be limited to what the application requires.
| Record | What It Helps Establish |
|---|---|
| Passport and identity details | Correct identification across records. |
| Orders and case references | Which authority imposed the restriction and its terms. |
| Notification records | When a decision was received or learned of. |
| Earlier applications and replies | What has already been requested and decided. |
| Travel and supporting evidence | Purpose, dates, urgency and proposed return. |
| Authority to represent | The lawyer's authority for the agreed work. |
Fees depend on the file, urgency and agreed tasks. Initial review, drafting, hearings and later applications may require different work. Translation, notarial and other necessary expenses should be explained separately. Neither a legal fee nor an official payment guarantees a favourable decision.
14 / From Review To Follow-Up
Steps in an Exit Ban Matter
- 01
Identify
Establish the person, order, authority and urgent dates.
- 02
Review
Read the file and separate any other restrictions.
- 03
Prepare
Select the appropriate request and supporting evidence.
- 04
Apply
Submit through the proper procedure and track the response.
- 05
Follow Up
Review the outcome, notification and remaining conditions.
Timing depends on access to records, the stage of proceedings and the authority's response. An urgent request should explain the urgency with evidence. It does not guarantee a same-day decision or a particular flight.
If the application is refused, the next step depends on the reasons, available objection procedure and any new facts. Repeating the same request without addressing the decision may not help. The client should receive a clear explanation of the outcome and any deadline requiring action.
15 / Before Making Travel Arrangements
Checking Travel Conditions After a New Order
A decision lifting or changing an exit ban should be read in full. Check whose restriction it concerns, whether relief is permanent or temporary, the permitted dates and any conditions. Other judicial control duties continue unless they are also changed.
The decision and its communication to the relevant authorities are separate practical steps. Counsel can follow up on the required correspondence and any identified mismatch. A copy held by the traveller should not be treated as proof that every relevant record has already been updated.
Check for separate restrictions in other files and the validity of the passport. Permission to leave Turkey does not establish a right to enter the destination country or return to Turkey later. Those questions require their own review.
Where temporary travel is allowed, keep the itinerary and evidence of compliance with the order. If dates change or an unexpected event prevents compliance, seek legal advice promptly. Do not assume that an informal explanation or an unused ticket extends the period allowed by the court.
16 / FAQ
Questions About Exit Bans in Turkey
Is An Exit Ban A Criminal Conviction?
No. Judicial control is a procedural measure, not a finding of guilt. The allegation and the need for a travel restriction are separate questions.
Is An Exit Ban The Same As An Entry Ban?
No. An exit ban restricts leaving Turkey. An entry ban concerns admission. Different procedures may apply, and a person can have both types of record.
Does An Empty UYAP Search Mean I Can Travel?
No. Portal information is useful but is not a clearance certificate. The relevant order, case records and any other restrictions need separate checks.
Can Paying A Fine Remove The Ban?
Paying a fine does not automatically cancel a judicial exit ban. Establish the basis of the restriction and whether a new court decision is required.
What Is The General Objection Deadline?
The general rule in Article 268 is two weeks from learning of the decision in the legally relevant manner. The notice, decision and any special or transitional rule must be reviewed.
Can The Court Allow Temporary Travel?
A temporary exemption may be requested under the judicial control rules. It needs a supported application and a decision. Travel must comply with the dates and conditions actually ordered.
Does The Ban End After Four Months?
Not automatically. Four months is the maximum interval for the periodic review under Article 110, not a universal expiry date. The order and statutory duration rules must be checked.
Can I Leave As Soon As I Submit An Objection?
No. Filing does not automatically suspend the order. An effective decision changing the restriction is needed, together with attention to its communication and any other travel obstacles.
