01 / Legal framework
Overstay and Visa Problems in Turkey
An overstay means remaining in Turkey beyond the period allowed by your visa, visa exemption or other permission. It can affect departure, future entry and later applications. The first step is to establish the dates and the legal basis of your stay.
- First review
- Permission, travel dates and any official notices
- Separate consequences
- Payment, entry restrictions and removal decisions
Paying an assessed amount does not automatically resolve every immigration issue. A fine, an entry ban and a removal decision are different measures. Each may need a different response.
Legal Istanbul advises people whose permission has expired, visitors preparing to leave and applicants facing difficulties returning. The review identifies what has happened, which documents are missing and what steps remain available.
If you have received a decision or are being held by the authorities, say so at the first contact. A discussion about fees or future travel should not delay review of an urgent court deadline.
02 / Legal services
Review of Your Stay and Available Legal Steps
Our work begins with your immigration records and intended next step. Someone preparing to leave may need different advice from a person already abroad with an entry restriction.
Checking Dates and Status
Reviewing travel history, visa conditions, permits and application records to establish the relevant period of stay.
Reviewing Departure and Payments
Examining notices, assessed charges, payment evidence and the issues that need attention before departure.
Assessing Official Decisions
Identifying the decision, notification date and appropriate procedure where a payment or immigration measure is disputed.
Planning a Lawful Return
Reviewing remaining restrictions and the conditions for a future visa, entry or residence application.
The engagement sets out the work, legal fees and responsibility for deadlines. Translation, notarisation and court costs may be separate. A document review does not automatically include a court case or representation at every later stage.
Explain any earlier advice or application made on your behalf. Copies of what was actually submitted are more useful than an assurance that an intermediary has dealt with the matter.
03 / Reading your permission
Visa Validity and Permitted Stay
The date until which a visa is valid is not necessarily the date until which you may stay. Check the permitted number of days, entry conditions and any shorter limit that applies to your passport or visa category.
| Term | Meaning | Common misunderstanding |
|---|---|---|
| Visa validity | The period during which the visa can be used under its conditions. | It is not a grant of continuous stay for that whole period. |
| Duration of stay | The number of days the permission allows. | A thirty-day allowance is not automatically ninety days. |
| Number of entries | Whether one or more entries are permitted. | Multiple entry does not mean unlimited days. |
| Purpose of visit | The activity covered by the permission. | A visitor visa is not general permission to work. |
A visa-free traveller also has conditions to meet. Passport type, nationality and the purpose of travel matter. Check the Ministry of Foreign Affairs' country-specific visa information rather than applying another traveller's allowance to your case.
Keep the full visa or e-Visa document, including its conditions. A payment email or screenshot of the expiry date may leave out the part that limits your stay.
04 / Travel history
The Ninety-Day Limit and Earlier Visits
The general visa and visa-exemption framework limits stays to ninety days in any 180-day period. This is a maximum, not a promise that every nationality or visa receives ninety days. A shorter permission still applies.
Review the relevant earlier visits as well as the current trip. Leaving briefly and returning does not automatically provide a new full allowance. A second passport should not be treated as a separate set of permitted days.
- A shorter visa allowance
- A visa allowing thirty days does not permit a sixty-day visit merely because its validity covers several months.
- Several visits
- Under a ninety-day allowance, sixty days already used within the relevant period cannot be ignored when planning the next visit.
Use exact entry and departure records. Where stamps are unclear, a journey is missing or a permit covered part of the period, the calculation needs further review. Do not round calendar months into thirty-day blocks or rely only on flight bookings.
Sources: Ministry of Foreign Affairs visa guidance and official e-Visa guidance on repeat visits. These examples do not determine an individual's last lawful day.
Check your travel dates with the 90/180-day calculator, and read the overstay guide for the distinction between fines and entry bans.
05 / Changes in status
Expired Residence or Work Permission
An expired residence permit raises different questions from a visitor using up a visa allowance. Check whether an extension was submitted in time, what document was issued and whether the application remains active.
The official residence guidance requires extension applications before the existing permission expires. A later appointment date does not, on its own, show that an application was late. Equally, an unfinished online form is not evidence that a valid application was completed.
Article 24 of Law No. 6458 provides a document for extension applicants that allows them to remain until a decision, even if the existing permit expires. Confirm that this is the document and procedure that apply to your case.
A cancelled work permit or the end of employment may also affect the right to stay. The dates of the employment change, permit decision and notification need to be considered together. A proposed new job is not a replacement for the required permission.
Do not assume that marriage, owning a home or having a company automatically corrects an expired status. These facts may support a separate application, but the existing stay still needs review. See our residence permit service and work permit service for those procedures.
06 / Financial consequences
Overstay Fines and Official Assessments
There is no single daily fine that can reliably be quoted for every foreign national. The applicable charges can depend on nationality, age, the type of breach and its duration. The responsible authority determines the amount due.
| Detail | Reason for checking | Useful record |
|---|---|---|
| Person identified | The assessment must relate to the correct traveller. | Passport or foreigner identity details. |
| Period assessed | Dates may affect the calculation. | Travel, permit and application records. |
| Type of charge | Different fees, penalties or public debts can have different grounds. | The written assessment and reference number. |
| Payment recorded | A receipt should be matched to the relevant amount. | Official receipt and payment reference. |
An informal estimate is not an official assessment. Ask what the amount covers and keep the supporting paperwork. A payment made through an intermediary should be supported by an official record, not only the intermediary's invoice.
If a charge appears wrong, obtain the decision and seek advice on the procedure and deadline for review. Do not assume that every immigration payment is challenged in the same court or within the same period.
The Istanbul Migration Directorate's published questions and answers identify nationality, age and the period of the breach as relevant factors. No fixed personal fee is quoted on this page.
07 / Before leaving Turkey
Preparing for Departure After an Overstay
Review your position before the travel date where possible. Check your passport or travel document, any departure instruction and the records needed to explain the stay. A booking confirms a travel arrangement, not the legal consequences of leaving.

If you have been formally invited to leave, examine the conditions and period stated in the decision. That is different from arranging departure before any removal process starts. Do not assume an ordinary flight booking replaces compliance with an official instruction.
Ask about the applicable payment arrangements in advance and allow time for the procedure. Keep copies of every document provided, including notices that may affect future entry. Request language assistance where you cannot understand a document's meaning.
If departure is prevented by illness or another serious event, preserve evidence of the dates and actual obstacle. Explain the problem promptly to the appropriate authority and counsel rather than assuming it automatically extends your permission.
08 / Departure categories
When an Overstay May Lead to an Entry Ban
Migration Management's notice dated 9 June 2020 distinguishes departure circumstances as well as the length of a breach. Its published categories should not be read as permission to remain unlawfully.
| Situation | Published approach | Important limit |
|---|---|---|
| Less than three months, voluntary departure before detection, required amounts paid | No entry ban under this category. | All conditions matter. |
| Longer breach, voluntary departure before detection, payment made | Different ban periods apply. | Payment does not ensure unrestricted return. |
| Non-payment or certain enforced-departure situations | A different category may apply. | The departure record needs review. |
This is not a three-month grace period. Separate restrictions can remain relevant. The notice also states that unpaid fines and other public debts may prevent entry after a ban period ends.

Preserve the written notice and its notification date. An oral statement about when to return may not explain every active measure. Our entry-ban service addresses record review, legal challenges and permission to enter.
09 / Applications in progress
Residence Applications and Travel While Waiting
Distinguish an appointment confirmation from the official residence permit application document. The timing, acceptance and status of the application matter. A document should be read for the rights and conditions it actually records.
The e-Ikamet guidance provides a specific short-trip arrangement for qualifying applicants using the application document and required fee receipts. It includes return within fifteen days and other conditions. It is not a general travel right based only on an online appointment.
Before travelling, check whether the document has been issued and whether the proposed journey falls within its conditions. Remaining abroad longer may bring ordinary visa rules into play. A pending application should not be treated as a substitute for checking re-entry.
If permission has already expired, a late application is not automatically a solution. Acceptance and any explanation for delay need individual review. Do not submit inaccurate dates or assume that starting another form cancels the earlier history.
Source: official e-Ikamet application-document guidance. Our residence permit service explains application requirements separately.
10 / Visas and the purpose of travel
New Visas, E-Visas and Refused Applications
A new e-Visa should not be used as a way to extend an expired stay from inside Turkey. The official e-Visa guidance states that a new application cannot be made without departure when the existing e-Visa expires.
For a later journey, the correct route depends on passport type, nationality, purpose and any supporting-document conditions. A tourist or business visit is different from employment or study. Check the requirements before paying an agent or making non-refundable bookings.
Where a visa application has been refused, keep the notice, application copy and documents submitted. The response should address the stated problem. Repeating the same application without correcting a material error may leave the issue unresolved.
A visa does not guarantee admission or automatically cancel a recorded entry ban. Any earlier overstay should be accurately disclosed where requested. A changed passport number does not remove immigration history.

11 / Notices and legal remedies
Different Decisions Require Different Responses
Identify the document before choosing a remedy. A payment query, an entry-ban request and a removal case do not perform the same function.
| Measure | Main question | Action to consider |
|---|---|---|
| Financial assessment | Are the amount and legal basis correct? | Check the specific review procedure. |
| Entry restriction | What prevents a future return? | Review the record, reasons and challenge deadline. |
| Removal decision | May the person lawfully be removed? | Check the seven-day court filing period immediately. |
| Administrative detention | Is continued detention lawful and necessary? | Consider a separate detention challenge. |
Article 53 provides seven days from notification to challenge a removal decision before the administrative court. A fine enquiry or future visa application does not protect that period. The issuing authority must also be informed of the court application.
Unless the person consents to removal, the law prevents removal during the filing period and until timely proceedings conclude. This does not itself end detention. Our deportation and detention service explains the two procedures.

12 / Personal circumstances
Illness, Family Responsibilities and Protection Needs
A serious illness, pregnancy, a dependent child or an event preventing travel may be relevant to the assessment. Evidence should show what happened, when it happened and how it affected the ability to leave or complete a procedure.
A medical report should explain the practical issue, such as inability to travel or the need for continuing treatment. A cancelled flight should be supported by the airline's records and any replacement arrangements. These circumstances do not automatically erase the earlier stay.
If return would expose the person to persecution, torture or another serious danger, explain this privately to counsel. The safeguards in Law No. 6458 and any protection procedure require a separate assessment. A fear of return is not merely a request to reduce a fine.
Where a child is affected, identify their own documents, permission and care arrangements. Do not assume that a parent's application or departure record automatically determines every family member's position. Each person's status may need to be checked.
13 / Preparing the file
Documents for an Overstay Review
Begin with the records available. Explain gaps rather than filling them with estimated dates. Sensitive documents can be shared through an agreed channel after the initial enquiry.
| Category | Examples | Purpose |
|---|---|---|
| Identity and travel | Relevant passports, entry and departure records. | Match the person and travel dates. |
| Permission to stay | Visa conditions, permits and application documents. | Identify the legal basis and its duration. |
| Official decisions | Refusal, cancellation, departure or entry-ban notices. | Check reasons and notification dates. |
| Payment | Assessment, receipt and payment reference. | Confirm what was charged and paid. |
| Special circumstances | Medical reports, family records or cancelled-flight evidence. | Support the explanation of events. |
Provide full pages and readable copies, including signatures and dates. Keep original documents. A translation can help communication, but the original-language record should also be available.
A short timeline is useful where several permits or trips are involved. Separate confirmed dates from uncertain ones and identify who submitted each application. This reduces the risk of assessing the wrong period or overlooking a later decision.
14 / Working through the matter
From the First Review to the Next Application
- 01
Confirm the Timeline
Match permission dates with actual travel and applications.
- 02
Identify the Measures
Separate payment, entry, residence and removal issues.
- 03
Agree the Work
Confirm instructions, fees and urgent responsibilities.
- 04
Take the Relevant Steps
Prepare the agreed requests or proceedings with supporting records.
- 05
Review the Outcome
Check the decision, payments and conditions for the next step.
The sequence may change where a deadline is close. A pending request for information should not be allowed to hide a separate need to file a case. The initial review should identify those priorities.
Where action has been taken, retain the application reference and evidence of delivery. Ask what the request covers and what still needs attention. A general statement that a file is being processed does not explain whether a restriction has ended.
15 / Future travel
Checking the Position Before Returning
There is no single waiting period that guarantees return after every overstay. Before booking, check the relevant ban, any other restriction, payment records and the conditions of the proposed visit.
The end of a stated ban period is only part of the review. A separate permission requirement or unresolved decision may remain. A new visa, passport or invitation letter should not be assumed to override it.
Where a record is wrong, the review should identify the error and supporting evidence. Where a restriction remains legally in force, an appropriate challenge or permission request may be needed. These are different tasks, and neither should be described as an automatic database deletion.
Plan later applications around the genuine reason for the visit. Keep the account consistent with earlier documents and explain relevant changes. Our overstay guide provides further background; advice on an individual return must use the current record.
