01 / International Couples
Marriage in Turkey and the Applicable Law
Foreign nationals can marry in Turkey when they meet the relevant legal conditions and complete the civil marriage procedure. The partners may have the same nationality, different nationalities, or include a Turkish citizen. The documents and legal checks depend on that background, not simply on the chosen wedding venue.
Legal Istanbul advises international couples on marriage requirements, foreign records and related legal questions. Advice may be needed before documents are ordered, after an office raises a concern, or when the marriage record will be used abroad. Our work concerns the legal procedure rather than wedding planning.
The Civil Code and Marriage Regulation govern the Turkish procedure. Article 13 of Law No. 5718 generally refers each partner's legal ability to marry to their own national law, while the form of the ceremony follows the law of the country where it takes place. Special rules may apply to dual nationals and people without a nationality.
A celebration or religious ceremony alone does not create a Turkish civil marriage. Equally, completing a civil marriage does not settle every later question about residence, citizenship, property or recognition abroad. Those matters need their own assessment.
For details of the documents and lawful-stay requirements, see our 2026 guide to marriage in Turkey.
02 / Scope Of Advice
Legal Support Before and After Marriage
The first review identifies both partners, their civil status and the countries involved. We then agree the documents and procedures covered by the engagement.
Marriage Requirements
Reviewing nationality, previous marriages and any legal issue that may prevent the application from proceeding.
Foreign Documents
Checking the required records, certification route, translations and consistency of personal details.
Application Support
Communicating with the relevant office, reviewing requests and assisting with steps that can lawfully be handled by a representative.
Related Legal Matters
Advising on records after marriage and separately agreed residence, property or foreign-divorce questions.
A marriage office decides whether the application meets its legal requirements. A lawyer cannot replace the officer's decision or either partner's personal consent. Foreign-law advice, court proceedings and representation before another country's authorities may require a separate professional engagement.
Where the partners have different financial interests, especially over a property agreement, independent advice may be appropriate. We clarify whom the firm represents and any limits on joint instructions before accepting that work.
03 / Legal Conditions
Checking Whether Both Partners Can Marry
Both partners must be legally free to marry and able to give valid consent. An existing marriage, a prohibited family relationship or a question about legal capacity can prevent the process. Living separately from a former spouse is not the same as being divorced.
This service concerns adult couples. A case involving someone under eighteen needs a separate legal and safeguarding assessment; ordinary document guidance should not be treated as permission to marry. A foreign certificate also cannot be assumed to overcome a rule protecting Turkish public policy.
The review should include all nationalities held, changes of name and any previous marriage, even if the passport does not mention them. If a document records a different date of birth or civil status, explain the history rather than selecting whichever document appears easier to submit.
Consent must be personal and freely given. Family approval, a financial arrangement or a representative's signature cannot take the place of either partner's decision to marry.
04 / The Correct Authority
Choosing the Authority and Application Route
For marriages involving a foreign national, NVI guidance identifies authorised municipal marriage offices and civil registry directors. Confirm that the proposed office handles your circumstances before paying for translations or reserving a ceremony.
| Couple | Starting Point | Important Check |
|---|---|---|
| Turkish and foreign partner | Authorised Turkish marriage authority. | Turkish civil record and the foreign partner's accepted documents. |
| Two different foreign nationalities | Authorised Turkish marriage authority. | Each partner's national-law and document requirements. |
| The same foreign nationality | Turkish authority, or their consulate where legally available. | Whether that state authorises its consulate to conduct the marriage. |
| Protection status or statelessness | Marriage office and the authority holding the person's records. | Applicable status, identity and capacity-certificate procedure. |
For protection categories covered by the regulation, the provincial migration authority's records may support the capacity certificate. Do not assume that approaching a home-country consulate is appropriate for every protected person.
A municipality's booking rules are not a complete statement of national law. For example, Besiktas publishes its own upload and original-document appointment process. Another office may organise these steps differently. The venue and the authority responsible for the legal ceremony should be clearly identified.
05 / Preparing The File
Documents for a Marriage Application
Prepare a list for each partner. The following categories are a starting point; the final list depends on nationality, civil status and the receiving office. Not every applicant needs every document shown.
| Document | Purpose | Review Point |
|---|---|---|
| Passport or accepted identity record | Identifies the applicant. | Validity, nationality and consistent spelling. |
| Marriage capacity certificate | Addresses legal freedom to marry. | Issuer, required personal details and current status. |
| Birth or civil registry record | Supplies birth and family details where needed. | Whether these details already appear in an accepted certificate. |
| Divorce or death record | Explains how an earlier marriage ended. | Finality and any recognition or registration step. |
| Health report | Meets the marriage health-report requirement. | Accepted provider and report format. |
| Forms, photographs and status records | Completes the local application file. | Current format, required copies and any lawful-stay evidence. |
Keep complete copies, including reverse sides, seals and attached certificates. A photograph of the main page alone may miss an important note. Original documents may still be required after an online review.
Use the same spelling across the application and translations, supported by the underlying records. A translator should not silently correct a source document. A genuine difference may require an official correction or evidence linking the names.
06 / Civil Status Evidence
The Marriage Capacity Certificate
This document is often called a certificate of no impediment or a certificate of legal capacity to marry. Its purpose is to show that the person is legally able to enter the proposed marriage. The title used by the issuing country is not decisive.
A certificate may be issued by a competent authority abroad or, where available, that country's diplomatic or consular office. Check whether it contains the personal and family details required in Turkey and whether it clearly addresses the absence of a legal obstacle.
A passport, a divorce order and a personal statement that someone is single serve different purposes. One should not automatically be substituted for another. Where a country does not issue the usual certificate, the acceptable alternative needs confirmation before submission.
Ask about the certificate's issue date and permitted period of use. A general statement that all foreign documents remain valid for six months is unreliable. Different records and procedures may have different limits.
07 / Documents From Abroad
Apostille, Legalisation and Turkish Translation
Certification confirms the official origin of a document; translation makes its content readable in the required language. These are separate tasks. Neither process repairs incorrect civil-status information.
| Situation | Possible Route | Check First |
|---|---|---|
| Covered foreign public document | Apostille issued in the place of origin. | Convention application between the countries and to the document. |
| Apostille route unavailable | Relevant legalisation procedure. | Required authorities and order of certification. |
| Treaty-covered record | A possible exemption or simplified route. | Exact treaty, participating countries and accepted document format. |
| Consular document | Separate consular-document procedure. | Do not automatically apply the ordinary apostille route. |
Under the Hague Convention, an apostille confirms the signature, the signer's official role and relevant seal or stamp, not the truth of every statement. Documents issued by diplomatic or consular agents fall outside the Convention's ordinary scope.
Arrange an accepted Turkish translation and notarial approval where required, including relevant seals and notes. Confirm the order before commissioning work. Keep certification attached to the correct original or certified copy; mixing pages from different records can make a complete-looking file unusable.
08 / Divorce And Widowhood
Dealing with a Previous Marriage
A previous marriage must have legally ended before a new one can proceed. Obtain the full divorce decision and evidence that it is final, or the relevant death record. A court filing, separation agreement or hearing date does not necessarily establish divorce.
For a foreign divorce, the correct route depends on nationality, the decision and the registers involved. Administrative registration may be available where the legal conditions are met; other cases may require judicial recognition. Not every foreign divorce requires a Turkish court case.
Updating civil status is also different from enforcing financial or child-related parts of a judgment. A registry entry ending the marriage does not automatically enforce every order made abroad. Our foreign divorce guide explains that distinction.
Any applicable waiting period needs separate review, including whether a court can remove it. Do not apply a rule for Turkish citizens to every foreign national without checking the governing law. Resolve these points before treating a proposed ceremony date as achievable.
09 / Practical Preparation
Health Reports, Photographs and Stay Status
Confirm the accepted health-report provider with the marriage office before arranging examinations. A report from abroad or an unrelated medical certificate should not be assumed sufficient. Medical questions belong with the responsible healthcare professional.
Check photograph requirements, application signatures and whether the office needs an appointment to inspect originals. Municipal lists can differ in practical details such as photograph numbers. An online upload or preliminary email response is not final acceptance of the file.
A residence permit is not a universal precondition for every foreign marriage applicant. Couples visiting Turkey should nevertheless check their lawful stay, passport validity and the office's current requirements. A marriage appointment does not extend a visa or cancel an overstay.
If a partner has protection status, an entry restriction or an unresolved immigration issue, assess that position separately. Do not assume that the ordinary passport-and-visa checklist fits every case.
10 / From Review To Registration
The Main Steps in the Marriage Procedure
The order should follow the actual document requirements and appointment system. Some work can begin from abroad, but the couple should leave time for corrections and steps requiring personal attendance.
- 01
Review the Background
Confirm nationality, identity, previous marriages and the intended authority.
- 02
Prepare the Records
Obtain documents and arrange the required certification and translations.
- 03
Submit the File
Complete local requirements and address any missing or inconsistent information.
- 04
Attend the Ceremony
Both partners attend with accepted witnesses and an interpreter where needed.
- 05
Check the Records
Review the issued marriage documents and plan any later use abroad.
Some application steps may be completed through a representative with a suitable special power of attorney. The wording, identity details and formal requirements must match the task. A general authority to conduct legal work may not be sufficient.
Representation during preparation does not allow marriage by proxy at the ceremony. Keep a written record of what has been submitted, what remains outstanding and which appointment is actually confirmed.
11 / Personal Attendance
The Ceremony, Witnesses and Interpreter
Both partners must attend and personally express their consent before the authorised marriage officer. The civil ceremony requires at least two witnesses who meet the legal conditions. Check their identification and the office's arrangements in advance.
If a partner cannot understand the language of the ceremony sufficiently, arrange an interpreter accepted by the office. Confirm any qualification and identification requirements. A bilingual friend should not be relied on without checking whether the office will accept that person.
Any hearing, speech or other communication need should also be raised early so that the person's wishes can be understood. Legal consent should not depend on guessing what a prepared statement means.
Before signing, check names, birth details and other entries against the accepted documents. Where there is a mistake, ask the officer about the correction procedure. Do not change an official entry privately after the documents have been issued.
12 / Proof And Use Abroad
The Family Booklet and International Records
The family booklet is an important record of the completed marriage. An institution may instead ask for an official marriage extract. The multilingual extract commonly called Formula B is a separate document that may be useful for procedures abroad.
Ask the receiving foreign authority which record it requires and whether translation, certification or registration is necessary. A treaty exemption depends on its scope and the countries concerned. The word "international" on a document is not a promise of unconditional acceptance everywhere.
Recognition of the marriage and entry in a foreign civil register are related but different questions. Some countries require notification or registration; others assess the marriage through another procedure. Turkish legal advice alone cannot guarantee the foreign authority's decision.
If a name changes, coordinate the official records rather than assuming that a new family booklet updates a foreign passport. Confirm current name-recording rules for the people concerned and retain documents explaining any difference between old and new records.
13 / Separate Applications
Residence Rights and Citizenship by Marriage
Marriage does not automatically grant residence, citizenship or permission to work. A family residence application has its own conditions, including the sponsor's position and supporting evidence. Eligibility must be checked before relying on this route.
Current stay deadlines continue to matter while marriage documents are being prepared. Do not wait for a ceremony on the assumption that it will remove a previous immigration problem. Our residence permit service covers the separate application assessment.
The ordinary citizenship-by-marriage route requires at least three years of marriage to a Turkish citizen, with the marriage continuing and other statutory conditions met. These include family life and the absence of relevant national-security or public-order obstacles. Reaching three years does not mean automatic approval.
A couple's circumstances may change after marriage. Separation, a change of nationality or the death of a spouse can raise different legal questions. Review the specific rules rather than assuming every family-based application has the same outcome. Further advice is available through our Turkish citizenship service.
14 / Financial Arrangements
Marriage, Property and Written Agreements
Couples with property, savings or businesses in different countries should discuss financial arrangements before signing an agreement. The place of marriage alone does not determine the law governing every property issue. Article 15 of Law No. 5718 addresses applicable law for marital property.
Where the Turkish statutory regime applies, it generally provides participation in property earned during marriage, subject to detailed rules. This does not mean that every asset immediately becomes jointly owned. Personal property, gifts, inheritance and financial contributions require separate analysis.
A permitted property-regime agreement can be made before or after marriage, subject to formal requirements. Under Turkish law, notarial execution or approval is generally required; the Civil Code also provides for written notification of the selected regime during the marriage application.
A downloaded agreement should not be treated as effective across every country where the partners have assets. Independent advice, governing law, disclosure and the treatment of property abroad should be considered. A property agreement does not decide citizenship or replace a will.
15 / Planning And Difficulties
Timing, Costs and Problems with the File
There is no reliable fixed completion time for every international marriage. Foreign certificates, corrections, health appointments and available ceremony dates each affect the timetable. Avoid non-refundable travel plans based only on an informal estimate.
| Issue | Next Check | Do Not Assume |
|---|---|---|
| Different names or dates | Source records and official correction or linking evidence. | A translation can change the original facts. |
| Previous marriage still recorded | Final divorce evidence and the relevant registration route. | Separation is enough to marry again. |
| Certificate rejected or expired | Written reason, required format and issue date. | A new stamp solves every problem. |
| Preferred date unavailable | Confirmed bookings and remaining document steps. | A paid venue reserves an official ceremony. |
Costs can include official document fees, translation, notarial work, health-related charges, ceremony fees and legal fees. Ask which items are included in an estimate. Municipality, venue, date and additional legal proceedings can change the total.
If an application is refused, obtain the reason and relevant record. Missing documents, a disputed civil status and a formal refusal require different responses. Any review or court deadline must be assessed from the actual decision; further correspondence should not be assumed to protect it.
