02 / Scope Of Legal Work

How We Assist with Foreign Divorce Decisions

The first review establishes what has already happened abroad and which rights or records need attention in Turkey. We then agree the scope of representation and the documents required.

01

Decision and Route Review

Checking finality, the issuing authority, nationality and family records to identify the appropriate registration or court procedure.

02

Document Preparation

Reviewing certified copies, translations, proof of finality and the authority needed to act for the client.

03

Applications and Proceedings

Preparing the agreed application, handling court papers and addressing requests or objections within the engagement.

04

Records and Related Orders

Following up on the result and identifying separate steps for financial obligations, children or other affected records.

The agreement identifies the client and the work included. Appeals, debt collection, separate property claims and advice in the issuing country may require additional instructions. A lawyer acting for one former spouse is not the other person's independent adviser.

If the file includes a hearing notice, refusal or payment deadline, provide it at the start. An initial enquiry does not mean the firm has accepted responsibility for an approaching deadline.

03 / The Result You Need

Registration, Recognition or Enforcement?

The title of the foreign document is not enough to choose the route. Its issuing authority, legal effect and final status matter. The same file may require more than one procedure.

The Main Routes And Their Limits
PurposePossible RouteImportant Limit
Update a Turkish family recordAdministrative registration of a qualifying foreign decision. The legal conditions and application requirements must be met.
Establish binding divorce statusCourt recognition of a final foreign judgment. The court checks recognition conditions, not a fresh divorce claim.
Collect money ordered abroadEnforcement under the applicable law or treaty.Recording the divorce alone is not permission to collect payment.
Give effect to child-related measuresThe relevant treaty or domestic procedure.Custody, contact, support and return proceedings are not identical.

A decision containing several orders should be reviewed part by part. The marriage may have ended finally while a financial issue remains under appeal. Whether a separate part can be used must be shown through the foreign court records, rather than assumed.

If no final foreign divorce exists, advice on divorce proceedings in Turkey may be needed instead. Recognition cannot turn a separation agreement into a divorce judgment.

04 / The Administrative Route

Registering a Foreign Divorce Without a Lawsuit

Administrative registration concerns eligible decisions of foreign judicial or administrative authorities. The authority must have been competent under its own law, the decision must be final and the result must not clearly conflict with Turkish public policy. Public policy concerns basic legal principles, not every difference between the two legal systems.

The application is made through the competent Turkish consular mission or designated population office in Turkey. Do not assume that any consulate or district office can accept the file. The issuing country, consular district and domestic application arrangements should be confirmed before an appointment.

Some countries allow divorce through a non-court procedure. Official French consular guidance, for example, addresses qualifying notarial divorces. This does not mean that every private agreement or religious document from every country can be registered in the same way.

The relevant Turkish family record must also be identified. Two foreign nationals who have no such record may need different evidence for a Turkish marriage application or another legal purpose. A procedure designed to update a Turkish family register should not be presented as the answer to every foreign couple's situation.

05 / Participation And Exceptions

Must Both Former Spouses Apply?

Where joint participation is required, the parties may apply together or separately through the permitted procedure. Separate applications must be coordinated with the same receiving authority. Official guidance gives a maximum interval of 90 days between those applications. This is not a promised processing time or a universal deadline measured from the divorce.

A missing or unwilling former spouse does not always make court proceedings necessary. The rules allow a Turkish party to apply alone in specified circumstances involving a foreign or deceased other party. Current consular guidance should be checked for the evidence needed, including any relevant inability to contact the foreign party.

Blue Card status and dual nationality require careful review. A former Turkish citizen is not automatically treated in the same way as every other foreign national for this procedure. All nationalities and the actual registry status should be disclosed.

Existing Turkish proceedings or an earlier refusal of recognition may prevent the administrative route. Provide complete decisions and information about how any earlier case ended. Do not make a declaration that no case exists simply because it was opened many years ago.

06 / Status Of The Decision

Showing That the Foreign Divorce Is Final

Finality means that the relevant decision has reached the legally required final stage under the issuing country's rules. A hearing result, provisional order or unsigned draft may not be enough. The date printed at the top of a judgment does not necessarily show when it became final.

Some decisions carry a finality note. Others require a separate certificate or official confirmation. Ask the issuing court or the lawyer handling the foreign case which document proves the divorce is final and whether an appeal affects all or only part of the judgment.

A certificate confirming marital status may be useful but may not replace the full judgment and finality evidence for court recognition. Keep the documents linked through matching case numbers, names and dates.

Where a foreign procedure has several stages, provide the complete sequence. A decree that permits a later final divorce must not be described as already ending the marriage. Translation and certification cannot make an unfinished foreign procedure final.

07 / Preparing A Complete File

Documents for Registration or Court Recognition

The exact list depends on the issuing country and chosen route. Start with readable copies for assessment, then obtain originals or accepted certified copies where required. A partial photograph of a judgment rarely provides enough information.

Records To Prepare For Legal Review
DocumentPurposeCommon Check
Complete foreign decisionShows the authority, case and orders made. All pages, attachments and accepted certification.
Proof of finalityEstablishes the final status and relevant date.A finality note or separate official certificate.
Identity and family recordsConnects the decision to the correct people and marriage.Nationality, name changes and registry differences.
Service and earlier case papersExplains notice, participation and prior proceedings.Addresses, delivery records and previous decisions.
Power of attorneyAuthorises the agreed representation.Specific wording, photograph and required formalities.

Explain spelling differences, changes of surname and missing registry details before filing. Documents from different countries may identify the same person differently. Supporting records are preferable to informal handwritten corrections on an official document.

08 / Foreign Public Documents

Apostilles, Certification and Turkish Translation

An apostille confirms the origin of a public document, including the relevant signature or seal. It does not confirm that the legal reasoning is correct, make the divorce final or grant recognition in Turkey.

The certification route depends on the countries, document type and applicable agreements. An apostille may be available under the Hague Convention; another legalisation procedure may be needed where it does not apply. Some agreements remove certification requirements for particular documents. It is therefore unsafe to order an apostille for every item without checking.

Confirm the accepted form of Turkish translation with the receiving authority. The translation should include the judgment, relevant attachments, finality proof and certification text where required. Translating only the short paragraph that declares the divorce can leave important information missing.

Arrange certification and translation in the correct order to avoid paying twice. Keep clear scans and a record of any originals sent. The required format should be confirmed before documents are posted internationally, especially where replacing an original could take time.

09 / Judicial Review

Conditions for Recognition by a Turkish Court

Court recognition is not a new trial about why the marriage ended. The Turkish court examines the legal conditions for giving the foreign judgment effect. Disagreement with the foreign outcome alone is not the same as a valid recognition objection.

Main Recognition Checks Under Law No. 5718
QuestionLegal ConcernRelevant Evidence
Is there a final foreign court judgment? The decision must fall within the legal recognition framework.Authenticated judgment and proof of finality.
Were jurisdiction limits respected?Turkish exclusive jurisdiction and, if objected to, a foreign court acting without a genuine connection.Case history, residence and the foreign court's basis for hearing it.
Is there a clear public-policy conflict?A serious conflict with basic Turkish legal principles. The actual decision and its legal effects.
Were defence rights respected?Relevant objections about notice, representation or absence contrary to the issuing law.Service records and participation in the foreign proceedings.

Reciprocity is not required for recognition under Article 58. In plain terms, recognition does not depend on the other country giving Turkish judgments the same treatment. This does not remove the remaining recognition conditions.

The absence of a bilateral treaty is therefore not, by itself, a reason to reject recognition. Enforcement of a separate order may raise different questions.

10 / Filing And Formal Notice

The Correct Court and Service of Papers

Foreign divorce recognition is generally handled by the family court, or the court acting in that role. The correct location follows the applicable jurisdiction rules rather than the applicant's preferred city.

The respondent is the person against whom the application is brought. Article 51 of Law No. 5718 starts with that person's domicile in Turkey, meaning their settled legal home. If there is no such domicile, it refers to the place where the respondent stays. If neither exists in Turkey, the courts of Ankara, Istanbul or Izmir are available under that provision. The applicant's own address is not an automatic replacement for these tests.

The petition must identify the decision and the recognition or enforcement requested. Court papers must be served through the legally accepted procedure. For a person abroad, the country, address, treaty arrangements and translation requirements can affect the steps involved.

A former spouse cannot necessarily stop recognition simply by refusing to agree. However, their right to receive notice and raise relevant objections must be respected. Give accurate address information; informal contact through email or messaging is not automatically valid court service.

11 / Authority To Act

Legal Representation While You Are Abroad

Many preparation and procedural steps can be handled by a lawyer under a suitable power of attorney. Confirm its wording before signing at a consulate or foreign notary. A general authorisation for business or banking may not cover the required family-law work.

The document may need specific authority, a photograph and an accepted certification and translation process. Signing abroad does not remove those requirements. The appropriate format depends on the route and issuing authority.

Representation can reduce the need for travel, but it should not be presented as a promise that personal attendance will never be needed. Administrative appointments, identity checks or a particular court direction may require separate arrangements.

Provide reliable contact details and agree how original documents and notices will be handled. Tell the lawyer promptly if an address changes. Advice about the validity or appeal of the foreign decision may require a lawyer in that country; a Turkish recognition engagement does not automatically include foreign proceedings.

13 / Problems In The File

Missing Documents, Objections and Refusals

Common difficulties include incomplete judgments, missing finality evidence, inconsistent identity details, unsuitable powers of attorney and overseas service problems. A request for an additional document should be distinguished from a final refusal.

If an authority refuses registration, obtain the written reason and the complete application record. Court recognition may remain available, depending on the issue. An administrative refusal does not necessarily mean that the foreign divorce can never have effect in Turkey.

A court refusal requires its own review of the reasoning, service and available challenge. Do not assume that making a new administrative application removes the effect of an earlier judgment. Any appeal or other procedural deadline must be checked promptly.

Provide previous applications even if they were prepared without legal help. Repeated filings with different explanations can make the record harder to assess. The next step should address the identified problem rather than simply repeat the same documents.

14 / Using The Result

Family Records, New Marriage and Related Rights

After the required procedure, check the resulting family record instead of assuming the application alone completed the update. Names, dates and the recorded marital status should match the accepted decision.

Under Article 59, the binding effect of a recognised judgment reaches back to the date it became final abroad. The Turkish recognition date and the foreign finality date are not interchangeable. Population guidance also refers to the foreign finality date when recording the divorce.

This distinction may matter for later family or inheritance questions. It does not justify a general claim that a former spouse keeps all inheritance rights until registration. Equally, do not calculate every financial claim deadline from the registration date; the particular right and applicable rules need separate review.

Before a new marriage, confirm the current record and the documents required by the marriage authority. Our marriage service addresses that process. Anyone relying on a family-based immigration status should also seek residence permit advice promptly. Delayed registration should not be treated as extending immigration rights or restarting reporting periods.

15 / Planning The Application

Work Stages, Timing and Costs

  1. 01

    Assess the Decision

Review the country, parties, finality and intended use.

  2. 02

    Choose the Route

Identify registration, recognition and any separate enforcement work.

  3. 03

    Prepare the File

Obtain the required copies, translations and authority to act.

  4. 04

    Handle the Application

Address submission, notice, requests and relevant objections.

  5. 05

    Check the Outcome

Confirm the decision, records and agreed follow-up steps.

No single completion period applies to every foreign divorce. Document availability, appointment arrangements, court workload, overseas service and appeals can affect timing. The 90-day interval for separate administrative applications is not a guarantee that the whole procedure ends within 90 days.

Legal fees are separate from court or administrative charges, translations, certification, delivery and foreign document costs. The engagement should state whether appeals, record follow-up and enforcement are included. A court award of costs does not necessarily reimburse the full private fee agreement.

A short chronology helps the initial review: marriage, foreign proceedings, final decision, previous Turkish applications and the outcome now needed. Mention any planned marriage or urgent payment issue without assuming that a personal target date can determine the authority's timetable.

16 / Questions About Foreign Divorces

Common Questions About Foreign Divorce Recognition

Does Every Foreign Divorce Require A Turkish Lawsuit?

No. Qualifying decisions may be registered administratively. A court procedure may be needed where that route is unavailable or another legal effect is sought. The complete decision and family records should be reviewed first.

What If My Former Spouse Will Not Cooperate?

Check the participation rules before assuming registration is impossible. Specified situations involving a foreign or deceased other party allow a Turkish party to apply alone. Court recognition may be another route, with proper notice and the right to raise objections.

Is The 90-Day Period A Processing Guarantee?

No. It concerns the interval between separate applications where joint participation is required. It is not a universal filing deadline after divorce or a promise that registration or a court case will finish within that time.

Is An Apostille Enough To Recognise The Divorce?

No. An apostille confirms the origin of the document. Finality, translation, the correct application and the other legal conditions still need attention. The certification route itself depends on the relevant international rules.

Is A Recognition Treaty With The Other Country Required?

Not simply for recognition under Article 58 of Law No. 5718, which does not require reciprocity. Separate enforcement may involve reciprocity or a treaty-specific procedure. The absence of a treaty does not decide every case.

Can A Lawyer Handle The Application While I Am Abroad?

Many steps can be handled through a suitable power of attorney. Its wording and formalities must be checked first. Representation does not guarantee that every appointment, identity check or court direction can be completed without personal attendance.

Does Registration Also Enforce Maintenance Or Custody?

No. Updating marital status does not automatically enforce all other orders. Payment, parenting and property provisions require separate review under the relevant law and any applicable international agreement.

Which Date Counts As The Divorce Date?

The foreign finality date is important, not simply the date of the Turkish application. Article 59 gives recognised judgments effect from foreign finality. The consequences for a particular claim, record or immigration duty still need individual review.
