BlogA foreign buyer may be able to cancel a property transaction in Turkey and recover money paid, but the answer depends on the agreement, the payment's legal purpose and the reason for cancellation. A reservation payment, a contractual withdrawal payment and an instalment under a prepaid housing sale are not the same thing. Calling all of them a non-refundable deposit can hide important differences.
Before sending a cancellation message or accepting a deduction, establish what was signed, who received the money and whether title has already transferred. The right approach may be withdrawal, a claim arising from the seller's breach, repayment under an invalid agreement or a negotiated exit. Each route has different consequences.

1. Can a Foreign Buyer Cancel and Recover the Deposit?
Sometimes, but foreign nationality does not itself create a special right to cancel. The assessment starts with the transaction and the applicable law. A buyer purchasing a home from a professional developer may have consumer protections that do not apply in the same way to a private resale or a commercial acquisition.
The reason for leaving the transaction matters. A seller who cannot deliver the promised title presents a different issue from a buyer who has simply found a cheaper apartment. An agreed financing condition, a contractual exit clause or a statutory withdrawal right can also change the position.
The immediate practical task is to preserve the agreement, payment evidence and relevant dates. Do not assume that a short reservation form is legally unimportant because the final sale has not taken place. Equally, a sentence saying non-refundable should not be treated as decisive without checking the agreement's validity and any mandatory consumer rules.
| Situation | Route to examine | Main distinction |
|---|---|---|
| Qualifying prepaid housing sale within 14 days | Statutory consumer withdrawal | Not a right applying to every resale. |
| Later exit from a qualifying prepaid housing contract | Separate statutory rescission rules | Permitted deductions and refund timing may differ. |
| Seller fails to meet an obligation | Breach-based remedies | Evidence and the required notice matter. |
| Buyer changes plans in a private resale | Contractual exit or negotiated settlement | No automatic consumer cooling-off right. |
A reservation payment or an invalid agreement needs its own assessment; the label deposit does not decide the result.
2. Identify the Agreement and the Stage of the Purchase
A reservation form, a promise of sale and a completed title deed transfer perform different functions. Turkish property transactions are subject to formal requirements, and a privately signed paper does not itself transfer ownership. For a promise of sale, the required formal instrument should not be confused with simply certifying signatures on a private document.
The Ministry of Trade's March 2026 prepaid housing guidance specifically explains the formal routes for those consumer transactions. It also warns that payment cannot be demanded under any label before a valid prepaid housing contract is established. That is a useful reason to examine the legal document, rather than relying only on a developer's description of a reservation fee.
If the agreement is defective in form, the consequences for repayment and other claims still need legal analysis. It is not enough to say that nothing was signed at the land registry and therefore every payment will automatically be returned. The documents, payment recipient and work actually performed must be considered together.
Where ownership has already transferred, a refund discussion may also require arrangements for returning title and dealing with registered rights. Mortgages, third-party interests or an annotation linked to a citizenship application can complicate an exit. Do not sign a transfer-back document or release on the assumption that the refund will follow informally.
3. Does Kapora Mean the Money Is Non-Refundable?
Not by itself. Under Article 177 of the Turkish Code of Obligations, money given when a contract is made is generally treated as evidence of the agreement, rather than automatically as a price for walking away. Its treatment also depends on the agreement and applicable rules. The everyday word kapora does not settle that classification.
Article 178 addresses a specifically agreed withdrawal payment. Under that arrangement, the paying party who withdraws leaves the payment, while the receiving party who withdraws returns twice the amount. This is not a universal double-refund rule for every failed property sale. There must be a legally effective arrangement to which that rule applies.
Read the receipt and payment clause alongside the rest of the transaction. A reservation fee may have been paid to an agent rather than the seller, and an agency commission may be governed by a separate agreement. Establish who received each amount, on whose authority and for what stated purpose before deciding whom to pursue.
The refund calculation should therefore separate the purchase payment, any alleged withdrawal charge and any distinct service fee. A seller or agent should be asked to identify the contractual and legal basis of a proposed deduction. An unexplained percentage is not a substitute for that assessment.

4. the 14-Day Right and the Separate Prepaid Housing Exit Route
For a qualifying consumer prepaid housing sale, the rules provide a 14-day withdrawal right from the contract date without a reason or contractual penalty. This protection should not be extended to every property purchase simply because the buyer is an individual. The sale must fall within the relevant consumer framework.
There is also a distinct right to withdraw from a qualifying prepaid housing contract within 24 months, subject to the applicable rules. Permitted expenses and compensation can differ from the initial 14-day route. The Prepaid Housing Sales Regulation, Articles 8-9, distinguishes these rights and their consequences. They should not be described as one long penalty-free cooling-off period.
Notice and repayment timing also differ. The regulation provides for the notice to be directed to the seller through a notary; an informal chat with a sales representative should not be assumed to preserve the right. The applicable refund deadline is generally 14 days after receipt of the initial withdrawal notice, compared with up to 180 days for the separate rescission route. The facts and any special grounds must be checked before applying those periods.
For an ordinary private resale, a change of mind does not automatically create either consumer right. The contract, validity of the arrangement and any agreed conditions become central. If bank finance, a valuation or another condition was essential to the purchase, establish whether it was actually made part of the agreement.
Before Accepting a Cancellation Deduction
Legal Istanbul can review which withdrawal or refund rules apply to your transaction and assess the proposed terms.
5. What If the Seller Cannot Deliver What Was Promised?
Failure to transfer the agreed title, substantial delivery problems or a mismatch between the promised and actual property may support remedies different from a voluntary change of mind. The contractual obligation, due date and evidence of the failure must be identified. Not every disappointing feature amounts to a legal ground for cancellation.
In qualifying prepaid housing transactions, the rules identify circumstances in which the buyer can exit without the usual deductions, including the seller's failure to perform its obligations. That question should be considered before accepting a standard cancellation charge. A developer's form headed voluntary withdrawal may not accurately reflect a dispute about non-performance.
The appropriate response may require notice, an opportunity to perform or another procedural step, depending on the ground. A demand should explain the actual issue and the remedy sought without making unsupported allegations. If the problem is late construction, our delayed delivery guide addresses that situation in more detail.
Cancellation, repayment and compensation are related but separate questions. A claim for additional loss needs its own legal and evidential basis. A payment dispute should not automatically be described as fraud, and a criminal complaint should not be presented as a guaranteed method of obtaining a refund.
6. Build a Clear Payment and Contract Record
A useful file links the signed agreement and amendments to each payment. Record the date, currency, amount, recipient and stated purpose, supported by bank records or receipts. If money was sent to a person other than the named seller, preserve the instruction or authorisation explaining why.
Keep the relevant sales correspondence, property description and any written promise about completion, finance or repayment. Preserve the original messages and documents rather than only a few cropped screenshots. The objective is a clear sequence of events, not a large collection of unrelated material.
Separate what was promised before payment from explanations given after the dispute arose. A later proposal to refund part of the price may be a settlement offer rather than an admission of every claim. The wording and context should be reviewed before it is relied on or accepted.
For an overseas buyer, a concise chronology can make the initial assessment much more efficient. State whether title or keys were received, whether a notice has already been sent and whether further instalments are due. Our property payment guide explains related payment-record precautions.
7. Agreeing a Refund Without Giving up Too Much
A negotiated exit can be practical where the refund terms are clear and payment is realistic. The agreement should identify the amount, currency, payment date, deductions and the person or company responsible. If instalments are proposed, the consequences of a missed payment and any available security deserve attention.
A release should be coordinated with actual repayment and any return of title or other rights. Signing a statement that all money has been received when only a promise has been made can create a further dispute. The same care applies to replacing a refund claim with another apartment, a credit note or an open-ended promise of resale.
If settlement fails, the next route depends on the parties and legal relationship. Consumer, ordinary civil and commercial disputes do not necessarily follow the same forum or preliminary requirements. Counsel should assess any required mediation, the evidence for the claim and the prospects of collecting from the proposed defendant.
A valid claim does not guarantee that the debtor has recoverable assets. Interim protection may be considered where legal conditions support it, but an account or property cannot be frozen simply because a buyer asks. The cost and purpose of proceedings should be discussed alongside recovery prospects.
8. Review Your Cancellation Position with Legal Istanbul
Legal Istanbul can assess the agreement, payments and reason for cancellation to identify the available refund route. The review can distinguish a consumer withdrawal right from seller breach, an invalid arrangement or a negotiated exit, and evaluate the basis of any proposed deduction.
For a first enquiry, provide the contract date, property type, seller's identity, amount paid and whether ownership has transferred. Mention any upcoming instalment or notice deadline and any refund proposal already received. Sensitive financial documents can then be shared through an agreed channel.
The scope may include a legal notice, negotiations or representation in the appropriate proceedings. The result should be a clear position on rights, evidence and practical next steps, without a promise that every deposit is refundable. An enquiry alone does not suspend payment obligations or preserve a statutory deadline.

9. FAQ
Is a property deposit called kapora always non-refundable in Turkey?
No. The word alone does not determine the legal result. The agreement, payment purpose, contract validity and applicable consumer rules must be assessed before deciding whether the money can be retained.
Does every property buyer have 14 days to cancel?
No. The statutory 14-day right discussed here concerns qualifying consumer prepaid housing sales. It should not be assumed to apply to every completed purchase, private resale or commercial property transaction.
Can I cancel a prepaid housing contract after the first 14 days?
A separate statutory route may be available within 24 months for qualifying contracts. Its deductions, notice and repayment rules differ from the initial penalty-free withdrawal right. Seller non-performance or other special grounds also require separate assessment.
Must the seller return twice my deposit if the sale fails?
Not automatically. Article 178 concerns a legally effective withdrawal-payment arrangement where the receiving party withdraws. A failed sale or a payment labelled kapora does not alone establish a right to double repayment.
Can I get a refund if the seller cannot transfer the promised title?
That may support breach-based or other remedies, but the agreement, reason for non-performance and evidence must be examined. The required notice and appropriate claim should be identified before accepting a voluntary-cancellation deduction.
Who is responsible if I paid the deposit to an estate agent?
The receipt, payment instruction and agent's authority need review. The agent may have received money for the seller or under a separate service arrangement. A purchase refund and an agency-fee dispute should not automatically be treated as the same claim.
Is a WhatsApp message enough to cancel a prepaid housing contract?
Do not assume so. The prepaid housing regulation provides for withdrawal or rescission notice through a notary within the applicable period. Informal discussions with a sales representative may not protect the statutory right.
When should money be returned after statutory prepaid housing withdrawal?
The applicable rules generally provide 14 days from receipt of the initial withdrawal notice, while the separate rescission route can allow up to 180 days. The transaction and legal basis must be checked before applying either deadline.
Can I pursue a refund while living outside Turkey?
Appropriate representation may allow notices, negotiations and proceedings to be handled under a suitable power of attorney. Existing title rights, original documents and any transfer-back arrangements still need attention. Recovery is not guaranteed merely because a claim is legally justified.
