BlogWhen an off-plan property in Turkey is late, the buyer may have options to pursue delivery, compensation or an exit from the transaction. The available remedy depends on the agreement, the applicable consumer rules, the cause of delay and the buyer's own performance. A revised date from the sales office does not necessarily replace the original obligation.
The practical choice is whether the property remains worth waiting for or whether a refund claim offers a more realistic solution. That decision needs both a legal assessment and a reliable picture of the project. A strong cancellation claim is of limited comfort if repayment cannot be collected.

1. What Can a Foreign Buyer Do About Late Delivery?
Start by identifying the promised property, delivery date and seller responsible. The business selling the apartment, the landowner and the construction contractor may be different entities. A demand sent to the sales agent alone may not reach the party that owes the obligation.
The response can involve a formal demand for completion, a documented extension, a claim for delay-related loss or a legally supported cancellation and refund. These are not interchangeable choices. The notice should preserve the intended remedy, and any election between remedies should be considered before an unconditional statement is sent.
Foreign nationality does not exclude consumer protection, but not every foreign purchase qualifies as a consumer transaction. The buyer's purpose, seller's professional role and contract structure matter. A commercial property investment or a private resale should not automatically be analysed as a prepaid consumer housing sale.
| Objective | Route to assess | Key question |
|---|---|---|
| Receive the agreed property | Completion demand or documented extension | Is a lawful, realistic handover still achievable? |
| Recover delay-related loss | Contractual payment or damages claim | What clause or evidence supports the amount? |
| Leave the transaction | Cancellation and repayment claim | What legal ground and notice are required? |
| Accept a nearly completed unit | Controlled handover with appropriate reservations | Which defects and rights remain outstanding? |
These options require individual assessment; they cannot always be combined without qualification.

2. Which Delivery Date Applies?
Read the signed contract, specifications and amendments together. Distinguish a binding delivery date from a marketing estimate, and identify whether any extension clause is valid and applicable. A buyer's signature on a new timetable can affect the position, particularly if it is accompanied by a release of earlier claims.
The Ministry of Trade's March 2026 guidance states that delivery under the prepaid housing framework cannot exceed 48 months from the contract date. It also explains that a shorter contractual period binds the seller. The statutory maximum is therefore not an automatic extension of a promised 24-month delivery date.
The same guidance distinguishes legal delivery from simply handing over keys. Registration and, where relevant, possession in a habitable condition matter under the applicable delivery route. A site visit or an invitation to collect keys should not be treated as proof that all contractual and statutory obligations have been fulfilled.
3. Should You Keep Paying Instalments During the Delay?
Do not stop payments solely because construction appears slow. Check whether the next instalment is tied to a date, a construction milestone or a reciprocal obligation. There may be a legal basis to withhold performance in a particular case, but an unsupported payment stoppage can give the seller a separate default argument.
Reconcile the purchase price against bank transfers, receipts and any credits. Payments to an agent or related company need to be linked to the seller's instruction and the relevant apartment. If the developer disputes the balance, resolve the factual discrepancy before presenting the buyer as fully paid.
The payment history also affects a refund calculation. Keep the original currency and dates visible rather than converting everything into a single informal figure. Interest, exchange-rate issues, alleged deductions and any additional loss should be assessed on their own legal basis.
4. Check Whether Completion Is Still Credible
The assessment should connect the physical project with the permit, title and contractual records. A finished sample apartment does not establish that the purchased unit can be lawfully delivered. Identify the relevant independent section, remaining works, occupancy position and any obstacle to the promised title deed transfer.
Ask what supports the developer's revised plan: a realistic construction programme, required approvals and an explanation of the outstanding work. Technical inspection may be useful where progress or quality is disputed. Dated reports and photographs can be more informative than repeated assurances that completion is close.
An allegation of force majeure needs to be tested against the event, its actual effect and the contract and mandatory rules. Increased costs or a general reference to market conditions do not, by themselves, answer whether the seller has a legal excuse. Any alleged contribution by the buyer to the delay must also be considered.

5. Use the Notice to Support the Remedy You Want
A notice can identify the overdue obligation, demand performance and preserve claims, but its content and timing should follow the selected legal route. Under the Code of Obligations, default and remedies in reciprocal contracts require attention to matters including whether a further period for performance is necessary. One generic cancellation letter will not fit every transaction.
If the buyer still wants the apartment, a negotiated extension should identify measurable completion obligations and a clear final date. It should also address existing delay claims, payments, inspection and the consequences of further failure. Merely accepting another projected date can leave the main disagreement unresolved.
Keep discussions with the sales office consistent with formal correspondence. A message accepting full completion can complicate a later allegation that delivery never occurred. Equally, demanding both continued performance and unconditional cancellation without explaining the legal position can create unnecessary uncertainty.
Still Waiting for a Clear Delivery Date?
Legal Istanbul can assess the contract and delay record before you accept another extension or commit to cancellation.
6. Cancellation, Refunds and Delay Compensation
A sufficiently established failure to perform may support cancellation or other remedies, but the contract, notice history and applicable rules must be reviewed. For qualifying prepaid housing sales, the Prepaid Housing Sales Regulation distinguishes seller non-performance from an ordinary reason-free exit. Do not accept a standard voluntary-cancellation deduction without checking that distinction.
A contractual delay payment, documented rental expenditure and other alleged losses may involve different tests. A penalty clause does not make every additional claim automatically recoverable, and loss should not be counted twice. Preserve the clause, expense records and evidence connecting the loss to the delay.
Before pursuing a refund, assess the seller's ability to repay and any available security. A settlement should address payment dates, currency and the sequence for returning title or other rights. Our property cancellation and deposit guide explains the separate withdrawal and refund routes.
7. If You Accept Delivery, Record What Remains Outstanding
A handover should identify the unit, keys, condition, missing works and relevant documents. If the apartment can be used but defects remain, record them clearly and obtain advice on notices and reservations. A broad statement that the buyer has no further claim should not be treated as a routine receipt.
Review title deed transfer and final-payment conditions alongside the physical inspection. Common areas, utilities and the occupancy position may matter even where the interior looks complete. Legal and technical checks address different questions and should inform the same completion decision.
For a buyer abroad, arrange who can inspect and what the representative may sign. Authority to receive keys should not unintentionally become authority to waive compensation or accept a materially different property. The mandate should match the intended handover tasks.
8. Review a Delayed Project with Legal Istanbul
Legal Istanbul can review the agreement, payment record and project information to compare completion, compensation and refund options. The aim is to identify the strongest available route and its practical limits, including notice requirements and recovery prospects.
Start with the contract date, promised delivery date, amount paid and the developer's latest explanation. Mention any amendment, notice, proposed release or approaching instalment. A short chronology allows the urgent issue to be identified before a larger document review.
The agreed work may include legal notices, settlement terms or proceedings in the appropriate forum. No fixed completion date or recovery can be promised without the file. For earlier-stage transactions, our foreign buyer's checklist covers the wider purchase review.

9. FAQ
Can a foreign buyer claim compensation for delayed construction in Turkey?
Possibly. The contract, legal ground, cause of delay and evidence of loss must be reviewed. A late project does not automatically establish a particular compensation amount.
Does the developer always have 48 months to deliver?
No. The prepaid housing framework sets a maximum, but a shorter agreed delivery period binds the seller. The maximum should not be treated as an automatic extension of the contract.
Does receiving the keys count as full legal delivery?
Not necessarily. The applicable title, possession and habitability requirements must also be met. Keys alone do not establish that every contractual and statutory obligation has been performed.
Can I stop paying instalments because the project is late?
Do not assume so. The payment condition, reciprocal obligations and any legal basis for withholding performance need review. An unsupported stoppage may expose the buyer to a default allegation.
Can I cancel rather than wait for completion?
Cancellation may be available depending on the breach, applicable rules and notice requirements. Seller non-performance should be distinguished from an ordinary change of mind before assessing deductions or refund terms.
Must I accept a revised delivery date?
Not simply because the sales office proposes it. Review the legal effect of any amendment, including releases of past delay claims. A negotiated extension should clearly address completion and further non-performance.
Is a force majeure clause enough to excuse every delay?
No. The event, its actual effect, the clause and mandatory rules must be examined. A general reference to market conditions does not by itself resolve the seller's responsibility.
What documents help assess a delayed project?
The agreement, specifications, amendments, payment records, delivery correspondence and reliable project information are central. A dated chronology helps connect the promised performance with what actually happened.
Can a lawyer manage the dispute while I am abroad?
Appropriate representation can cover agreed notices, negotiations and proceedings. Inspection and handover authority should be planned separately, particularly where a representative may be asked to sign a release.
