BlogProperty division after divorce in Turkey does not mean automatically dividing everything the spouses own into equal shares. The applicable law, matrimonial regime, acquisition dates, funding and debts must be established first. A property registered in one spouse's name may still be relevant to a financial claim, while a participation claim does not necessarily transfer half the title.
For an international couple, the first question may be which country's law governs the assets rather than how much each spouse receives. The divorce, maintenance and liquidation of the property regime are distinct issues. A useful assessment separates them before calculating or negotiating a settlement.

1. Does the Divorce Judgment Divide All Property?
Not necessarily. Ending the marriage, awarding maintenance or divorce-related compensation and resolving matrimonial-property claims are different legal tasks. Read the actual claims, judgment and any settlement rather than assume that an amicable divorce automatically settled every asset.
A protocol may expressly resolve property issues, reserve them or contain wording whose effect needs interpretation. A broad release can matter even if the discussion focused on only one apartment. Conversely, silence about a particular asset should not be treated as proof of either a waiver or an entitlement without reviewing the legal context.
Identify whether the divorce is pending, final or completed abroad. The timing and procedural relationship between the divorce and property claim should be planned, including any urgent protection and limitation issue. Our divorce procedure guide explains the separate question of ending the marriage.
2. Which Law Applies to an International Couple?
Article 15 of Law No. 5718 contains the matrimonial-property conflict rules. A permitted choice of law, the spouses' nationality and habitual residence at the relevant time can affect the analysis. The provision separately addresses the law of the location of immovable property for liquidation.
A Turkish divorce therefore does not automatically answer every question about assets in several countries. Nor should the spouses' present address be substituted for the connecting factors required by law. Give counsel the marriage history, nationalities, residence history, any agreement and the location of significant assets.
Where Turkish law applies, the statutory participation-in-acquired-property regime is the starting point unless a different valid regime applies. Marriages spanning the transition on 1 January 2002 require attention to the relevant periods. A foreign prenuptial agreement needs review for its scope and legal effect rather than automatic acceptance or rejection.
3. Separate Acquired Property from Personal Property
The Civil Code's matrimonial-property provisions distinguish assets acquired for value during the regime from categories of personal property. Premarital assets, gifts and inheritances may be personal, while earnings and income from personal assets can require different treatment. The relevant agreement and evidence remain important.
For each major item, record acquisition, funding, later transfers and any replacement purchase. A home bought during marriage with proceeds from a premarital property raises a tracing question, not an automatic conclusion that all its value is acquired property. Preserve both transactions and the movement of funds.
| Asset or funding source | Question to examine | Useful evidence |
|---|---|---|
| Asset owned before the regime | Personal-property status and later income | Acquisition and income records. |
| Home bought with mixed funds | Source, timing and allocation of contributions | Transfers, gift evidence and loan schedule. |
| Inherited property | The inherited asset versus income or replacement assets | Inheritance and subsequent transaction records. |
| Company interest | Share ownership, contributions and income | Corporate records and reliable financial statements. |
The table assumes the relevant Turkish regime applies; an international case first requires an applicable-law assessment.
Under Article 225, where divorce is granted, the regime ends with effect from the date the divorce action was filed. That is not necessarily the date used to value every claim, nor the date the divorce became final. Keeping those dates separate helps avoid a calculation based on the wrong asset period.
4. Homes, Mortgages and Mixed Contributions
A family home may have been funded through savings, employment income, a gift and a mortgage. The legal treatment depends on the source and timing of those contributions. A transfer from a relative should be examined for who was intended to benefit rather than labelled a gift to one spouse without evidence.
Registered ownership and a matrimonial financial entitlement are separate. A claim concerning an asset held by the other spouse may result in money rather than registration of a half share. If both spouses already own shares, those interests must be accounted for before assessing any additional entitlement.
Loan instalments, improvements and contributions to the other spouse's property may require different calculations. Avoid counting the same payment as both a full reimbursement and part of another undifferentiated claim. Expert valuation is useful only when the legal assumptions and underlying documents are correct.
A settlement should show asset values, debts, personal-property treatment and adjustments before presenting a final figure. If one spouse keeps a mortgaged apartment, an agreement between spouses does not itself release the other borrower from the bank's rights. The financing arrangement must also be addressed.

5. How Are Company Shares and Business Income Treated?
A spouse's shares and the company's own property are different assets. A claim against the spouse does not automatically make the other spouse owner of half the company's bank balance or real estate. Obtain the share-acquisition history, capital changes and financial records before proposing a value.
Shares acquired before the relevant regime can raise different questions from later capital contributions or income received during it. Salary, distributed profits, retained earnings and shareholder loans should not simply be added together as if they were the same personal asset. Classification and valuation need to be coordinated.
The current practical challenge is often access to reliable records rather than identifying a headline percentage. A business valuation based on an old balance sheet may miss debt, related-party transactions or a recent transfer. Our shareholder dispute guide explains why ownership and corporate information rights must also be distinguished.
Need a Clearer Picture Before Discussing a Settlement?
Legal Istanbul can assess the relevant property regime, funding history and records needed for a supported calculation.
6. Evidence and the Risk of Asset Disposal
Prepare a focused asset list with available title, account, investment, loan and business records. Separate known facts from suspicions about undisclosed wealth. Identifying an institution, transfer or property makes a lawful evidence request more useful than a general allegation that assets are hidden.
Use records you are entitled to access. Do not obtain private passwords, impersonate the other spouse to a bank or remove confidential company data without authority. Where documents are unavailable, explain the gap so counsel can assess the appropriate procedural request.
If a sale, mortgage or transfer is threatened, identify the specific asset and supporting evidence promptly. The Civil Procedure Code provides a framework for interim protection and evidence, but a restriction is not automatic merely because divorce proceedings exist. The measure should fit the claim and risk.
A completed transfer is not necessarily beyond examination, but it is not automatically invalid either. Timing, purpose, calculation rules and third-party rights may matter. Preserve the transaction history rather than responding by concealing or transferring assets yourself.
7. a Settlement Must Be Capable of Performance
Identify the assets and claims covered, the payment amount and currency, transfer steps, deadlines and any rights reserved. If the bargain depends on selling an asset or obtaining finance, state how that will work. An agreement to share the proceeds later can leave substantial uncertainty about price, expenses and timing.
Coordinate payment with releases and registration. Taxes, fees, lender consent and the rights of third parties can affect performance even where the spouses agree. A broad statement that no further claims remain should be considered against the full asset picture before signature.
For assets or decisions abroad, check implementation in the relevant jurisdiction. A Turkish agreement does not necessarily complete a foreign transfer, and a foreign property settlement does not automatically change a Turkish title record. Our foreign divorce recognition guide distinguishes marital-status registration from enforcement of other orders.
8. Prepare a Property Assessment with Legal Istanbul
Legal Istanbul can assess the governing law, matrimonial regime, claim types and supporting records. The work may involve a focused asset review, coordination with valuation experts, protective applications or settlement and proceedings where appropriate.
Start with the marriage and divorce dates, nationalities, any marital agreement and the main assets and debts. Mention an intended sale, pending hearing or proposed release. Sensitive bank and family records can then be shared through an agreed channel.
The initial objective is a defensible assessment of what belongs in the calculation and what evidence is missing. It is not a promise of an equal division or a fixed recovery. A clear legal basis makes both litigation decisions and settlement negotiations more useful.

9. FAQ
Is everything divided equally after a Turkish divorce?
No. Applicable law, the matrimonial regime, personal-property categories, debts and adjustments must be established. Half of the gross value of all assets is not a reliable calculation.
Does a Turkish divorce mean Turkish law governs every asset?
Not necessarily. International matrimonial-property rules require a separate assessment, including nationality, relevant residence, any permitted choice of law and the location of immovable property.
Can I have a claim if the home is only in my spouse's name?
Possibly. Registered ownership does not alone determine matrimonial financial rights. The regime, acquisition and funding must be examined, and the remedy may be monetary rather than a transfer of title.
Are inherited assets included in the division?
Under the relevant Turkish statutory regime, an inherited asset may be personal property. Income, replacement purchases and mixed contributions need separate analysis. The source should be supported by records.
Which date ends the property regime when divorce is granted?
Article 225 gives effect to the end of the regime from the divorce filing date. That should not be confused with finality of the divorce or the valuation date used for a particular claim.
Does a mortgage reduce the property claim?
Relevant debt and the source and timing of repayments must be included in the assessment. The calculation should avoid double counting. A settlement between spouses does not automatically release either borrower from the lender's rights.
Will my spouse receive half of my company?
That is not an appropriate assumption. Shares, company assets, contributions and business income are distinct questions. The applicable regime and reliable valuation evidence determine the assessment.
What if my spouse is about to sell an asset?
Seek prompt advice about the identified asset, transaction and available evidence. Interim protection may be considered where legal conditions are met, but a divorce does not automatically freeze all property.
Does an agreed divorce protocol settle every financial claim?
It depends on the actual wording, claims and legal context. A protocol may settle or reserve property issues, and broad releases can have significant consequences. Review it before assuming further claims are available or excluded.
