Renting Out Property in Turkey as a Foreigner: Legal and Tax Points

Foreign owners can generally rent out property they lawfully own in Turkey. The rules depend on how the property will be let: an ordinary residential tenancy, a business lease and short-term accommodation should not be treated as the same arrangement.

Before advertising, settle the intended use, contract, payment route and tax responsibilities. Owners living abroad should also decide who may manage the property and how they will approve decisions, receive records and respond if the tenant stops paying.

1. Which Rental Model Are You Planning?

The tenant's use, length of stay and services offered help determine the relevant legal questions. A furnished apartment is not automatically a tourism rental, and calling an agreement a monthly lease does not remove the need to examine the actual arrangement.

Check the property's permitted use, building arrangements and any rights affecting the owner's ability to let it. Where the property is jointly owned or subject to another person's rights, authority to grant possession may require more than one person's decision. Ownership and permission for a particular activity should be assessed separately.

Rental projections should follow that review. A purchase calculation based on short stays can be misleading if the building cannot support the necessary permission. Buying a property and earning rent also do not, by themselves, establish a residence or work right in Turkey.

The legal classification follows the actual arrangement, not only the title used on the contract.

2. What Should the Lease Agreement Cover?

Identify the landlord and tenant, the exact property, permitted use, rent, payment date and method, deposit arrangements and responsibility for utilities and other charges. If the property is furnished, record the inventory and condition at handover so later disagreements can be assessed against evidence.

Residential and covered-workplace leases are subject to mandatory protections. Rent increases, deposits and termination provisions cannot simply be set without reference to those rules. Foreign ownership or a contract written in English does not remove the Turkish legal framework.

A clear agreement should also address repairs, access for legitimate inspections, subletting and the procedure for notices. Avoid relying on a generic clause that the tenant must leave whenever the owner asks. The practical goal is an enforceable arrangement that reflects how the property will actually be used.

Rental income, management authority and payment records should support the same file.

3. Is Turkish Rental Income Taxable If the Owner Lives Abroad?

Living abroad does not make income from Turkish property automatically tax-free. The owner's tax status, the nature of the letting and the applicable income-tax rules must be considered. Residential rent and business-premises rent can have different exemption, withholding and declaration treatment.

Use the rules for the income year concerned, not a threshold copied from an older article. Keep a record of gross rent, permitted expenses, any withholding and the ownership position. The Revenue Administration's rental-income guidance provides the current framework; an accountant should confirm the filing position for the actual owner and receipts.

The owner's home country may also require reporting, with treaty and foreign-tax-credit questions assessed separately. Property taxes, building charges and rental income tax are different obligations. Short-stay activity with additional services can require a different assessment from a straightforward residential lease.

4. How Should Rent Payments Be Recorded?

Use a payment route that leaves a reliable record of the tenant, property, period and amount. The Revenue Administration's guidance reflects the bank or PTT documentation requirement under Income Tax General Communique No. 328 for residential and business rents without the former small-payment threshold. A cash receipt should not be treated as an equivalent substitute for a payment that falls within that requirement.

Agree how the tenant will describe each transfer and how deposits or other sums will be distinguished from rent. If a manager collects payments, the owner should receive both the underlying collection record and the reconciliation of fees, expenses and net transfers. A monthly total without supporting detail can make arrears and tax preparation harder to verify.

Maintain the signed lease, handover record, payment history, invoices for relevant expenses and notices in one organised file. This is useful for routine management and for a later dispute. The records should remain accessible to the owner if the managing agent changes.

5. Can the Property Be Managed While the Owner Is Abroad?

A representative can handle agreed tasks, but the authority and reporting obligations should be clear. Distinguish advertising and viewings from signing a lease, collecting rent, approving repairs or taking legal action. A management agreement is not automatically a substitute for any formal power of attorney required for a particular act.

Set approval limits for expenditure and identify where rent and deposits will be held. The owner should know who may appoint contractors, negotiate a renewal and receive notices. Instructions to change payment details should be verified through an established channel rather than acted on solely through an unexpected message.

Review the management agreement's termination and handover provisions. Keys, tenant records, account information and outstanding repair matters should be returned in an orderly way. Legal representation in a tenancy dispute can be considered separately from day-to-day property management.

6. Do Short-Term Rentals Need a Tourism Permit?

The tourism-rental framework covers residential lettings for 100 days or less per agreement. The Ministry's application guide explains that the purpose of the stay is not decisive: business, education or health-related stays can also fall within the regime. It is not limited to a particular booking platform.

Check the permit and building conditions before accepting bookings. Required owner consents and the treatment of qualifying residence developments depend on the applicable category. The Ministry's current application page sets out the electronic process and supporting documents, including the position of foreign applicants.

A managing agent's promise to handle the listing is not evidence that the property is eligible. Ask who will hold the permission and perform the continuing obligations. Repeated short stays should not be disguised through a nominal longer contract; the actual operating model needs review.

7. What Happens If Rent Is Unpaid or the Owner Needs the Property Back?

Start with the lease and an accurate payment history. Confirm which amounts are overdue, what notices have been sent and whether the tenant disputes the rent or raises another issue. The appropriate enforcement or court route depends on the basis of the claim and compliance with the relevant procedure.

Expiry of a stated term does not automatically mean a residential tenant can be removed. Personal need, non-payment and other grounds have different requirements. Buying a tenanted property also does not itself guarantee immediate vacant possession.

Do not change locks, remove belongings or disconnect services as a substitute for lawful recovery. Those steps can create additional disputes. Our guide to tenant eviction for foreign owners explains why the grounds, notices and timing should be reviewed before action is taken.

8. Review the Letting Before It Becomes a Dispute

Legal Istanbul can review a proposed lease, an owner's management arrangements or a tenancy problem and explain the legal options. Tax filings and accounting should be coordinated with an appropriate specialist; a legal review does not replace the owner's reporting obligations.

For an initial enquiry, state the property location, proposed rental model, whether a tenant is already in occupation and the decision you need to make. If there is a dispute, include the date of any notice or planned action. Sensitive documents can be requested after the scope and communication channel are agreed.

9. FAQ

Can a foreign owner rent out an apartment in Turkey?

Generally, yes, subject to the property's legal position and the rules for the intended letting. Ordinary residential leases and short-term accommodation require different checks.

Does the owner need to live in Turkey to rent out the property?

Not necessarily. Management can be arranged from abroad, but representation, records, tax responsibilities and any activity-specific permissions still need attention.

Is Turkish rental income tax-free for a non-resident owner?

No automatic exemption follows from living abroad. The declaration, exemption and withholding position depends on the owner, income year and type of letting, with overseas reporting considered separately.

Can the tenant pay rent in cash?

Rent payments within the bank or PTT documentation requirement should use that prescribed route. Do not rely on the former small-payment threshold or assume a handwritten receipt fulfils the requirement.

Does a short business stay need to be considered under the tourism-rental rules?

Yes. The regime is not limited to holidaymakers. The length and nature of the letting matter, including stays for business, education or health purposes.

Can a property agent sign the lease for me?

Only with appropriate authority for the act concerned. Agree the representative's powers and approval limits rather than assuming an advertising or management instruction authorises every transaction.

Can I require the tenant to leave at the end of a one-year lease?

Not simply because the stated term has ended. Residential tenancy protections and the applicable termination grounds and procedures must be assessed.

Can I increase the rent to any amount agreed in the contract?

Mandatory rent-adjustment rules may limit the contractual provision. The lease type, relevant period and applicable law should be checked before demanding an increase.

What should I send a lawyer if the tenant stops paying?

Provide the signed lease, payment history, relevant correspondence and any notices or proceedings. A clear record of the amounts and dates is more useful than a general statement that rent is overdue.
